Dear Chairman/Presidents Name:

The U.S. Nuclear Regulatory Commission (NRC) has committed to contacting all Federally-recognized Native American Tribes every 5 years to determine whether they would be interested in receiving, or continue to receive, advance notification of certain types of nuclear waste shipments and commercial irradiated reactor fuel shipments that are transported within or across Tribal reservations. The advance notification requirements for these materials are found in Title 10 of the Code of Federal Regulations (10 CFR) 71.97 and 73.37, respectively.

Affected Tribes listed in the enclosure have been identified as currently having NRC-approved transportation routes that pass within or across Tribal reservations. If you are one of the Tribes identified in the enclosure and choose to receive advance notifications, your Tribe will be obligated to protect the schedules and itineraries of the shipments according to the NRCs Safeguards Information (SGI) requirements in 10 CFR 73.21 and 10 CFR 73.22. If you currently do not receive advance notifications and want to begin receiving notifications, the Tribal leadership would need to provide the NRC the following information: (1) the names and their contact information for a primary and secondary point of contact to receive notifications; (2) confirmation that the points of contact provided have completed the required SGI training; and (3) confirmation that the NRC has accurately depicted the Tribal reservation on a map.

Training on SGI-related information protection and reservation maps with approved transportation routes are available upon request for the identified Tribes in the enclosure from the NRC project manager listed below.

Note that Tribes have the option to receive or not receive advance notifications by informing the NRC at any time. If your Tribe chooses not to receive advance notification of shipments, no action is necessary. The NRC also plans to continue notifying any Tribe of new route approvals that pass within or across their Tribal reservations.
