SECTION 7 BIOLOGICALCONSULTATION, ST. LUCIE PLANT, UNITS 1 AND 2 (TAC NOS. M99396 AND M99397)

Dear Mr. Plunkett:

In accordance with the Section 7 consultation process associated with the Endangered Species Act (ESA), enclosed is a revised Incidental Take Statement (ITS) issued by the National Marine Fisheries Service (NMFS) of the Department of Commerce on May 8, 1998.

Based on the January 20, 1998, meeting between the Nuclear Regulatory Commission (NRC), NMFS, the Florida Power and Light Company (FPL), and the Florida Department of Environmental Protection, NMFS has modified portions of the terms and conditions necessary to monitor and minimize the lethal take of sea turtles at St. Lucie. The annual, incidental, lethal take levels specified in the ITS included in the February 7, 1997, Biological Opinion have not been changed.

Although NMFS continues to endorse the conclusion that the continued operation of St. Lucie Units 1 and 2 is not likelyto jeopardize the continued existence of species listed in the opinion under their jurisdiction, NMFS and the NRC believe the implementation of the terms and conditions of the ITS is needed.

In order for the NRC to fulfillits responsibility under Section 7 of the ESA, as detailed in 40 CFR 402, it is requested that FPL supplement its December 1, 1997, application for changes to the Environmental Protection Plan, Appendix B of the St. Lucie, Unit 1 and 2, licenses to reflect the revised ITS. These changes should be submitted to the NRC within 60 days of receipt of this letter or August 1, 1998, whichever is later.
