LUCIE PlANT," UNITS 1

AND 2 (TAC NOS.

H92014 AND H92015)

Dear Hr. Plunkett:

Enclosed is the Biological Opinion issued by the National Marine Fisheries Service (NMFS) of the Department of Commerce on February 7,

1997.

NHFS has concluded that the continued operation of St. Lucie Units 1 and 2 is not likely to jeopardize the continued existence of species listed in the opinion under their jurisdiction.

However, NHFS has also concluded that operation of St.

Lucie Units 1 and 2 may adversely affect these species.

Therefore, NHFS has developed an Incidental Take Statement, which is included with the Biological Opinion, which includes terms and conditions'ecessary to monitor and minimize the lethal take of sea turtles at St. Lucie.

An exploratory meeting was held at the St. Lucie site on'May 7, 1997, to discuss the Biological Opinion and Incidental Take Statement.

In order for the Nuclear Regulatory Commission to fulfill its responsibility under Section 7 of the Endangered Species

Act, as detailed in 50 CFR Part 402, it is requested that Florida Power and Light Company propose appropriate changes to the Environmental Protection
Plan, Appendices B of the St. Lucie, Units 1 and 2, licenses, within 60 days of receipt of this letter.

These proposed changes should reference the Incidental Take Statement included in the enclosed Biological Opinion and provide that reasonable and prudent

measures, as detailed in items
1) through
10) of the Incidental Take Statement, will be taken.
