Dear Hr. Goldberg:
This refers to the inspection
conducted
on August
10 through October
10,
1995,
at the St. Lucie facility.
The inspection
included
a review of the
circumstances
associated
with the failure of safety related relief valves to
reseat after lifting.
The results of this inspection
were sent to you by
letter dated October 26,
1995.
A closed predecisional
enforcement
conference
was conducted
in the Region II office on November
13,
1995, to discuss
the
apparent violations,
the root causes,
and your corrective actions to preclude
recurrence.
A list of conference
attendees,
NRC slides,
and
a copy of your
presentation
summary are enclosed.
Based
on the information developed
during the inspections
and the information
you provided during the conference,
the
NRC has determined that
a violation of
NRC requirements
occurred.
The violation is cited in the enclosed
Notice of
Violation (Notice)
and the circumstances
surrounding it are described
in
detail in the subject inspection report.
The violation described
in the
enclosed
Notice involved
a failure to take prompt,
comprehensive,
corrective
action for a series of similar equipment deficiencies.
Causal
factors
included (1)
a failure to develop into
a comprehensive
corrective action plan
in a timely manner,
and
(2)
a failure to develop
an understanding
of the
generic implications of the deficiencies
on safe plant operation.
As
a result
of not acting promptly and generically
on information obtained
in February
and
Harch,
1995, the subject deficiency recurred
in Unit
1 in August,
1995,
resulting in a loss of approximately
4000 gallons of reactor coolant
inventory.
This event complicated
and delayed,a
unit cooldown which was
required for necessary
maintenance.
The violation is of concern
because it demonstrated
a lack of involvement
by
plant management
in the prioritization and tracking of identified
deficiencies.
Tracking
and accountability weaknesses
were similarly
identified in your corrective action
(STAR) program.
Although the August,
1995, manifestation of the subject
equipment deficiency did not have
a
significant consequence
on safety, your staff's pursuit of corrective actions
was not representative
of the thoroughness
and expediency
expected for issues
that are potentially important to safety
and that
have generic implications
affecting multiple safety systems.
The need for expediency
in this case
was
further borne out by the fact that the August,
1995,
event
prompted
a larger

study of the issue
which identified the
need for equipment
changes
in numerous
individual applications.
Consequently,
the enclosed violation is of more than
minor regulatory concern
and if left uncorrected,
could have
become
a
significant concerns
Similar performance
in the future could result in
escalated
enforcement
action.
You are required to respond to this letter and should follow the instructions
specified in the enclosed
Notice when preparing
you response.
In your
response,
you should
document
the specific actions
taken
and
any additional
actions
you plan to prevent recurrence.
After reviewing your response
to this
Notice, including your proposed corrective actions
and the results of future
inspections,
the
NRC will determine
whether further
NRC enforcement
action is
necessary
to ensure
compliance with NRC regulatory requirements.
In accordance
with 10 CFR 2.790 of the NRC's "Rules of Practice,"
a copy of
this letter, its enclosure,
and your response will be placed in the
NRC Public
Document
Room (PDR).
To the extent possible,
your response
should not include
any personal
privacy, proprietary, or safeguards
information so that it can
be
placed in the
PDR without reduction.
The responses
directed
by this letter and the enclosed
Notice are not subject
to the clearance
procedures
of the Office of Management
and Budget
as required
by the Paperwork
Reduction Act of 1980,
