LICENSEE RESPONSIBILITY UNDER 10 CFR PARTS 21, 50.72 AND 50.73 CONCERNING LITIGATION WITH COMBUSTION ENGINEERING-ST.
LUCIE UNIT 1
Dear Hr. Goldberg:
t'he NRC has recently been made aware of a complaint filed in Federal court in Miami by the Florida Power 5 Light Company concerning steam generators
'upplied by Combustion Engineering, Inc.'or use in St. Lucie Unit 1.'he NRC became aware of this complaint from a telephone call placed by a newspaper reporter who called one of our Project Managers.
,The resulting article appeared in a local business newspaper which i,ncluded remarks made by this Project Hanager.
At this time, the NRC has no position and thus,no comment on the merits of the complaint.
The remarks, although somewhat misqOoted, were those 'of, the Project Manager and not those of NRC.
H We wish to remind you of your responsibilities under 10 CFR Part 21 and Parts 50.72 and 50.73 for the review, evaluation, and reporting to NRC of defects in safety-related equipment, materials, and,services" which may be identified by you at any time, including during the review and discovery process resulting from the complaint.
