ORDER one 18, 198 On June 16, 1981, the Licensing Board entered an order dis-missing this operating license proceeding involving Unit 2 of the St. Lucie nuclear facility.
The basis of the dismissal was that the only admitted intervenor had notified the Board that she was withdrawing from the proceeding.
Previously, on June 3,
1981, the Licensing Board had entered an order in which it had, inter alia, denied a joint petition for leave to intervene filed by Parsons and Whittemore, Inc.
and Resources Recovery (Dade County), Inc.
Those petitioners have taken an appeal from that denial under 10 CFR'.714a.
The time for the filing of responses to the brief in support of the appeal has not yet expired.
Obviously, the validity of the June 16 order dismissing the proceeding hinges upon the outcome of the pending appeal.
For this reason, that order shall "not be accorded finality until such time as the appeal is determined.
It is so ORDERED.
