50-389 NOTICE OF ISSUANCE OF AMENDMENT TO CONSTRUCTION PERMIT Notice is hereby given that pursuant to a Memorandum and Order dated April 24, 1981 by the Atomic Safety and Licensing Board, the U. S. Nuclear Regu-latory Commission has issued Amendment No. 3 to Construction Permit No.
CPPR-144, which was issued to Florida Power and Light Company for construction of the St. Lucie Plant Unit 2, located in St. Lucie County, Florida.
Effective with the issuance of Amendment No.
2 on November 14, 1980, the current permit holders are Florida Power and Light Company and Orlando Utilities Commission of the City of Orlando, Florida.
The Board's Order authorizes the addition of antitrust conditions to the construction permit.
The Commission has found that the provisions of the amendment complies with the requirements of the Atomic Energy Act of 1954, as
- amended, and the Com-mission's regulations published in 10 CFR Chapter I.
Since the amendment only involves the addition of antitrust conditions, this action involves no safety questions or environmental impacts; i.e., this action does not involve a signi-ficant hazards consideration, does not constitute an unreasonable risk to the

health and safety of the public, and is not inimical to the common defense and security.
In addition, the issuance of this amendment will not result in any significant environmental impact and that pursuant to 10 CFR Section 51.5(d)(4) an environmental impact statement or negative declaration and environmental impact appraisal need not be prepared in connection with issuance of the amendment.
A copy of the Memorandum and Order, dated April 24, 1981, the construction permit, the amendment and other related documents are available for public inspection at the Commission's Public Document

(the Commission) has,received an application for a facility operating license from Florida Power 8 Light Company (applicant), to possess, use and'perate the St. Lucie Plant,.Unit 2, a pressurized water nuclear reactor (the facility),
located on the applicant's site on Hutchinson Island i'n St. Luci'e County,
'I Florida.
The reactor is designed to operate at a core power level of 2700 megawatts ther'mal, with a corresponding electric output of approximately 802 megawatts.
The applicant has also filed, pursuant to the National Environmental Policy Act of 1969 and the regulations of the Commission-in 10 CFR Part 51, an environ-mental report, The report, which discusses environmental considerations related to the proposed operation of the facility is being made available at the Bureau of Intergovernmental Realations, Division of State

7590-01 0 After the environmental report has been analyzed by the Commission's
- staff, a draft environmental statement will be prepared.
Upon preparation of -the draft environmental statement, the Commission will, among other things, cause to be published in the FEDERAL REGISTER, a notice of availability of the draft statement, requesting comments from interested persons on the draft statement.
The notice will also contain a statement to the effect that any comments of Federal agencies and State and local officials will be made available when received.
The draft environmental statement, will focus only on any matters which differ from those previously discussed in the final environmental state-ment prepared in connection with the.issuance of %he construction permit.
Upon consideration of comments submitted with respect to the draft environmental statement, the Commission's staff will prepare a final environmental statement, the availability of which will be published in the FEDERAL REGISTER.
The Commission will consider the issuance of a facility operating license to Flordia Power and Light Company which would authorize them to possess,'se and operate the St. Lucie Plant Unit 2 in accordance with the provisions of the I'icense and the technical specifications appended
- thereto, upon:
(1) the completion of a favorable safety evaluation of the application by the Commission's I
staff; (2) the completion of the environmental review required by the Commission's regulations in 10 CFR Part 51; (3) the receipt of a report on the applicant's applicati'on for a facility operating license by the Advisory Committee on Reactor Safeguards and (4) a finding by the Commission that the application for the facility license, as
- amended, complies with the requirements of the Atomic Energy I
Act of 1954, as amended (the Act), and the Commission's regulations in 10. CFR Chapter 1.
Construction of the facility was authorized by Construction Permit t
CPPR-144, issued by the Commission on Nay 2,'977.
Constuction of the St. Lucie
7590-01 Plant, Unit 2 is anticipated by the NRC to be completed by December 1983.

Prior to the issuance of an operating license, the NRC staff will study
. the Floodplain Aspects of the St. Lucie Plant, Unit 2 and issue an assessment pursuant to Executive Order 11988 Floodplain Management.
Prior to issuance of any operating license, the Commission will inspect
'the facility to determine whether it has been constwcted in accordance with the application, as amended, and the provisions of the construction permit.
In addition, the license will not.be issued until thj Commission has made the findings reflecting its review of the application under the Act, which will be setforth in the proposed lic'ense, and has concluded that the issuance of the license will not be inimical to the common defense and security or to the health and safety of the public.
Upon issuance of the license, the applicant will be t
required to execute an indemnity agreement as required by Section 170 of the Act and 10 CFR Part 140 of the Commission's regulations.
By March 30, 1981, the appliant may file a request for a hearing with respect to issuance of the facility operating license.. By April 7,
- 1981, any person whose interest may be affected by this proceeding may file a petition for leave to intervene:
Requests for a hearing and petitions for leave to inter-vene shall be filed in accordance with the Commission's "Rules of Practice for Domestic Licensing Proceedings" in 10 CFR Part 2.
If a request for hearing or petition for leave to intervene is filed by the above date, the Commission or an Atomic Safety and Licensing Board, designated by the Commission or hy Atomic order.
the Chairman of the Atomic Safety and Licensing Board Panel, will rule on the request and/or petition and the Secertary of the Commission, or designated Safety and Licensing Board will issue a notice of hearing or an appropriate

set forth with particularity the interest of the petitioner'in the proceeding, and how that interest may be affected by the results of the proceeding.
The petition should specifically explain the reasons why intervention should be permitted with par ticular reference to the following factors:

(2) the nature and extent of the petitioner's property, financial,.or other interest in the proceeding; and (3) the possible effect of any order which may b'e entered in the proceeding on the petitioner 's interest.

- proceeding as to which petitioner wishes to intervene.
Any person who has filed a petition for leave to intervene or who has been admitted as a party may amend his petition, but such an amended petition must satisfy the specifi-c

2 7590-01 DOCKET NO. 50-389 ISSUANCE OF DIRECTOR'S DECISION UNDER 10 CFR 2.206 On February 14, 1980, the Atomic Safety and Licensing Appeal Board denied a motion filed by the intervenors in the St. Lucie Unit 2 construction permit proceeding and referred the motion to the Director, Office of Nuclear Reactor Regulation, for consideration as a request for action under 10 CFR 2.206, See ALAB-579, ll NRC 223 (1980).
The motion requested actions with regard to the consideration of the environmental consequences of "Class 9" accidents at the St. Lucie Unit 2 facility.
Upon evaluation of the motion and related information in light of the Commission's new guidance on accident considerations at nuclear power plants (45 FR 40101), I have determined not to grant the requested relief.
Accordingly, the request for 'action is denied under 10 CFR 2.206.
The reasons for this decision are stated fully in a Director's Decision under 10 CFR 2.206", which is available for public inspection in the Commission's Public Document Room at 1717 H Street, N. W., Washington, D.
C. 20555, and in the local public document room at the Indian River Coranunity College Library, 3209 Virginia Avenue, Ft. Pierce, Florida 33450.
A copy of the decision will also be filed with the Secretary for the Commission's review in accordance with 10 CFR 2.206(c).
As provided in 10 CFR 2.206(c), this decision will become

, The Initial Decision dated April 19, 1977 fs subject to reviem by an Atomic Safety and Licensing Appeal Board prior to its becoming final. Any decision or ac-tion taken by an Atomic Safetv and Li-censing Appeal Board in connection with the Initial Decision may be reviewed by the Commission.
The Commission has made appropriate finding as required by the Atomic En-ergy Act of 1954, as amended (the Act),.
and the Commission's rules and regula-tions fn 10 CFR Chapter I, which ate set forth fn the construction permit. The ap-plication for the construction permit compiles with thc standards and requfre-ments of the Act and the Commission's rules and'regulations.
Construction Permit No. CPPR-144 in-cludes the condiUon that the permtt is subject to thc outcome of the proceed-ings in Natura/ Resources Defense Coun-cil v. NRC (D.C. Circuit, July 21, 1976)

In addftton, thc construction permit includes anti-trust conditions vvhich have been agreed (o by Florida Power and Light Company in a letter to the Commission dated March 18, 1977. This construction per-mit, however, ts issued subject to fur-ther action as may be deemed appropri-ate by the Commtssfon as a result of an antitrust procccdfng involving this factlfty now pendfng before an Atomic Safety and Licensing Board initiated by a group of Florida cities.

Order for Modification of License The Florida Power and Light Com-pany (the Licensee),
fs the holder of Facility Operating License No. DP~I which authorizes the operation of the nuclear power reactor known as Turkey Point Unit No. 4 (thc facility) at steady state reactor power levels not in excess of 2200 thermal megawatts (rated power). The facility is a pressurized water reactor (PWR) located at the Li-censee's site in Dade County Florida.
On February 8, 1977, Qte Nuclear Reg-ulatory Commtssion ordered Turkey Point Unit No. 4 be brought to a cold shutdown condition tn order to perform an inspection of steam gcncrators at the end of the current fuel cycle or mith-tn 120 equivalent days of,power opera-tion from February

- outage, a second leaking tube was dis-covered and was also plugged. The tube leaking incident was flrst observed in mid-February and progressed very slowly over a period in excess of one month.
The leakage behaved in a predicted fash-ion and had no safety consequences not previously evaluated.
After discussions with the NRC staff.
with respect to the lfcensee's assessment that continued facmty operation with the identified leaks plugged mould not endanger publfc health and safety and
'dfd not require'spcclflc aproval under the provisions of the Order. the Unit was returned to operation on March 25, 1977.
On April 2S.
1977. the ltcensee in-formed the NRC that they had detected another leak with an equivalent leak-age rate of about 0.04 GPM. By April 2V.
1977, the leakage rate had progressed to 0.14 GPM and the Unit was shutdown for investigation. On April 28, 1977, the NRC staff was informed that ttte leaking tubes mere fdentffled on the C steam generator (row 2column 47, row 2 column 61 and row 3-column 62). These three tubes are located near the inner tube lane in'a "hard spot" between flow slots. The elcvatlons of these leaks have been determined to be at the fourth and the fifthsupport plates.
By letter dated April 29, 1977, the li-censee submtttcdi (1) results of their inspection of the three leaking tubes and (2) their safety evaluation of the latest tube leak fncfdent. In addition, the li-censee rcquestcd NRC approval to resume power operation for the remaining fuel cycle, which was estimated to be about fifteen (15) equivalent days. The NRC staff has reviewed the submitted infor-mation and concurs that the resumption of power operation by Turkey Point Unit No. 4. willnot present a significan risk to the public health and safety.
'1'he information developed by the li-ccnsec's inspection fndfcates that the leaks are attributed to tube denting. The leaking tubes are located in "hardspot" regions where tube d:nting is predicted to be more severe than In other areas of the tube bundle. The leaks were located at about the level of the tube support plates.
Allleaks associated with dented tubes experienced to date have been small, well below the leakage limits established by license condition or Tcchnical Spcciflca-tfon. The leakage rate progresses slowly and fs detectable. Tube cracks which re-sult from severe denting are constraftYed
'within the tube support plates; and, thus.
any leaks caused by this type of crack will be limited even under accident condi-tfons.
Although there may be an additional leak that may develop during operation during the r'emaining short perfod untfl thc scheduled refueling outage, the Ifmfts on primary to secondary leakage rate wLil assure that such leaks do not become large enough to be unstable under acci-dent, loadtngs.
