7590-01 UNITED STATES HUCLEAR REGULATORY COMMISSION DOCKET NO. 50-335 FLORIDA POWER 5 LIGHT COMPANY NOTICE OF PROPOSED ISSUANCE OF AMENDMENT TO FACILITY OPERATING LICEHSE The United Sta'tes Huclear Regulatory Commission (the Commission) is considering the issuance of an amendment to Facility Operating License No. DPR-67 issued to Florida Power and Light Company (the licensee) for operation of the St. Lucie Plant, Unit 1, located in St. Lucie, Florida.
The amendment would revise the license and the technical specifications by upgrading rated power from 2560 Mwt to 2700 Mwt in accordance with the licensee's application for amendment dated November 14, 1980.
Prior to issuance of the proposed license amendment, the Commission will have made findings required by the Atomic Energy Act of 1954, as amended (the Act), and the Commission's regulations.

Pequests for a hearing and petitions for leave to intervene shall be filed in accordance with the Commission's "Rules of Practice for Domestic Licensing Proceedings" in 10 CFR Part 2. If a request for a hearing or petition for leave to intervene is filed by the above date, the Commission or an Atomic Safety and Licensing Board designated by the Commission or by the Chairman of the Atomic

. Safetv and Licensing Board Panel will rule on the request and/or petition and the Secretary or the designated Atomic Safety and Licensing Board will issue a notice of hearing or an appropriate order.
As required by 10 CFR $ 2.714;. a petition for leave to intervene shall set forth with particularity the interest of the petitioner in the proceeding, and
.how that interest may be affected by the results of the proceeding. The petition should specifically explain the reasons why intervention should be permitted with particular reference to the following factors: (1) the nature of the right under the Act to be made a party to the 'proceeding; (2) the 'etitioner's nature and extent of the petitioher's property, financial, or other interest in the proceeding; and (3) the possible effect of any order which may be entered in the proceeding on the petitioner's interest. The petition should also identify the specific aspect(s) of the subject matter of the proceeding as to which petitioner wishes to intervene. Any person who has filed a petition for leave to intervene or who has been admitted as a party may amend the petition without requesting leave of the Board up to fifteen (15) days prior to the first prehearing conference scheduled in the proceedi ng but such an amended petition must satisfy

UNITED STATES OF AMERICA NUCLEAR REGULATORY COMMISSION In the Matter of FLORIDA POWER AND LIGHT COMPANY Docket No. 50-335 (St. Lucie Nuclear Power Plant, Unit Ho. 1)
REVISED ORDER FOR MODIFICATION OF LICENSE Florida Power and -Light Company (licensee) is the holder of License No.
DPR-67, which authorizes the operation of- the St. Lucie Nuclear Power Plant Unit 1 at steady state reactor power levels not in excess of 2560 megawatts thermal (rated power). The facility consists of a Pressurized Water Reactor located at the licensee(s site in St. Lucie County, Florida.
On Hovember 4, 1977, the Union of Concerned Scientists (UCS) filed with the Commission a "Petition for Emergency and Remedial Relief." The petition sought action in two areas: fire protection for electrical cables, and environmental qualification of electrical components. By Memorandum and Order dated April 13, 1978 (7 NRC 400), the Commission denied certain aspects of the petition and, with respect to other aspects, ordered the NRC staff to take several related actions. UCS filed a Petition for Reconsideration on May 2, 1978. By Memorandum and Order, dated May 23, 1980, the Commission reaffirmed its April 13, 1978 decision
regarding the possible shutdown of operating reactors. However, Nay 23, 1980 decision directed licensees and the NRC the'ommission(s staff to undertake certain actions.
With respect to envirormental qualification of safety-related electrical equipment, the Commission determined that the provi sions of the two staff documents - the Division of Operating Reactors "Guidelines for Evaluating Environmental'ualification'f Class lE Electrical Equi pment in Operating Reactors" (DOR Guidelines) and NUREG-0588, "Interim Staff Position on Environmental gualification of Safety-Related Electrical Equipment," December 1979 "form the requirements which licensees and applicants must meet in order to satisfy those aspects of 10 CFR Part 50, Appendix A General Design Criterion (GDC-4), which relate to envi-ronmental qualification of safety-related electrical equi pment." The Commission directed, for replacement parts in operating plants, "unless there are sound reasons to the contrary, the 1974 standard in NUREG-0588 will apply." The Commission also directed the staff to complete its 1
review of the information sought from licensees by Bulletin 79-01B and to complete its review of environmental qualification of safety-related 1,
electrical equipment in all operating plants, including the publication of Safety Evaluation Reports, by February 1, 1981. The Commission T
Bulletin 79-01B was not sent to licensees for plants under review as part of the staff i's Systematic Evaluation Program. The information sought by Bulletin 79-01B was requested from these licensees by a series of letters and meetings during the months of February and March, 1980.
imposed a deadline that, "by no later than 'June 30, 1982 all safety-related electrical equipment in all operating plants shall be qualified to the DOR Guidelines or NUREG-0588." The Commission requested the staff to, "keep the Commission and the public apprised of any further findings of incomplete environmental qualification of safety-related electrical equipment, along with corrective actions taken or planned,"
and requested the staff to provide bi-monthly progress reports to the Commi ssi on.
The Commission further directed the" staff to add certain documentation requirements to each license after the specific requirements were approved by the Commission. The Commission also pointed out that the various deadlines imposed in its Order, "do not excuse a licensee from the obligation to modify or replace inadequate equipment promptly.".
The information developed during this proceeding emphasizes the importance of adequate documentation, the prompt completion of the revi ew of environ-mental qualification of safety-related electrical equipment, and the prompt ccmpletion of any plant modification needed to assure conformance with the DOR Guidelines or NUREG-0588. A significant aspect of this review i s the timely submittal of environmental qualification information by the operating plant licensees to enable the staff to ccmplete its review in accordance with the Commission i"s Order. The staff has a program presently underway to reevaluate, using the DOR Guidelines. and NUREG-0588, the qualifications of safety-related electrical equipment exposed
to environments that may exist following postulated accidents. These accidents are Loss of Coolant Accident and Hain Steam Line Break inside containment, and Hi.gh Energy Line Breaks inside and outside containment.
In this connection the licensee was requested by IKE Bulletin 79-01B dated January 14, 1980 to provide' detailed review of the environ-mental qualification of Class lE electrical equipment. This review was to include all equipment required to function under postulated accident conditions, both inside and outside the primary containment, and recognize all conditions specified in the bulletin. Evidence of qualification together with methods and justification, was requested.
Clarification was provided by supplemental information, briefings, and l
in some cases, meetings with the licensee. Timely completion of the staff s review of environmental qualification of electrical equipment and timely completion of needed modifications by the licensee is required to provide continuing reasonable assurance of public health and safety. Such completion is dependent on the prompt receipt of a complete response by the licensee to the staff(s requests for information.
However, the licenseel's response, to date, is incomplete.
Therefore, I have concluded that the public health, safety, an'd interest require that a firm schedule for the timely submission of all the information previously requested by the staff should be established by Order effective immediately.

Accordingly, pursuant to the Atomic Energy Act of 1954, as amended, and the Coranission's regulations in 10 CFR Parts 2 and 50, IT IS ORDERED THAT EFFECTIVE IMMEDIATELY Facility Operating License No. DPR-67 is hereby amended to add the following provisions:
"Information which fully and completely responds to the staff's request as specified in IEE Bulletin 79-01B, shall be submitted to the Director, Region II, Office of Inspection and.Enforcement, by the licensee not later than November 1, 1980."
An earlier response is encouraged to facilitate staff revi ew and issuance of the safety evaluation report. The licensee or any person whose interest may be affected by this Order may request a hearing within 20 days of the d fpbli i f li i d01 i h ~Fd 1R Arly request for a hearing will not stay the effective date'of this Order.
Any request for a hearing shall be addressed to the Director, Office of Nuclear Reactor Regulation, U.S. Nuclear Regulatory Commission, Washington, D. C. 20555. A copy of the request should also be sent to the Executive 4
Legal Director, U. S. Nuclear Regulatory Comnission, Washington, D. C.
20555, and to Robert Lowenstein, Esq., Lowenstein, Newman, -Reis and Alexrad, 1025 Connecticut Avenue, N. W., Washington, D. C., attorney for the licensee.
If a hearing is held concerning this Order, the issue to be considered at the hearing shall be whether the license should be modified to require submission of information as set forth in Section IV. of the Order.
Operating of the facility on terms consistent with this Order is not stayed by the pendency of any proceedings on the Order. This Order revises, in its entirety, the Order issued August 29, 1980, and published in the Federal Re ister September 11, 1980 (45 FR 60081).

Nuclear Regulatory Commission (the Commission) has issued Amendment No. 36 to Facility Operating License No. DPR-67, issued to Florida Power and Light Company (the licensee), which revised the license for operation of the St. Lucie Plant, Unit No. 1 (the facility), located in St.'Lucie County, Florida. The amendment is effective as of the date of and i's to be fully implemented within 30 days o Comnission approval 'ssuance in accordance with the provisions of 10 CFR 73.40(bj .
The amendment adds a license condition to include the Carmission-approved Safeguards Contingency Plan as part of the license .
The licensee's filings comply with the standards and re;-.'rements of the Atomic Energy Act of 1954, as amended (the Act), and the Commission's rules and regulations. The Commission has made appropriate =indings as required by the Act and the Commission's rules and regulations in 10 CFR Chapter I, which are set forth in the license amendments Prior public notice of the amendment was'. not required since the amendment does not involve a significant hazards considerati'on.
The Commission has determined that the issuance of the amendment will not result in any significant environmental impact and that. pursuant to 10 CFR 651.5(d)(4) an environmental impact statement or negative declar. tion and environmental impact appraisal need not be prepared in connection with issuance of the amendment.
The licensee's. filing dated June 19, 1980, is being withheld from public disclosure pursuant to 10 CFR 2.790(d). The withheld information is subject to disclosure i'n accordance with the provisions of 10 CFR 69 .12 .

ORDER FOR MODIFICATION OF LICENSE Florida Power and Light Company (licensee) is the holder of License No.
DPR-67, which authorizes the operation of the St. Lucie Nuclear Power Plant Unit 1 at steady state reactor power levels not in excess of 2560 megawatts thermal (rated power). The facility consists of' Pressurized
'<later Reactor located at the licensee's site in St. Lucie County, Florida.
On November 4, 1977, the Uni on of Concerned Scientists (UCS) f i led with tthe Commission a "Petition for Emergency and Remedial Relief." The petition sought action in two areas: fire protection for electrical cables, and environmental qualification of electrical components. By Memorandum and Order dated April 13, 1978 (7 NRC 400), the Commission denied certain aspects of the petition and, with respect to other aspects, ordered the NRC staff to take several related actions. UCS filed a Petition for Reconsideration on May 2, 1978. By Memorandum and Order, dated May 23, 1980, the Commission reaffirmed its April 13, 1978 decision
regarding the possible shutdown of operating reactors. However, the Cornnission's May 23, 1980 decision directed licensees and"the HRC staff to undertake certain actions.
~rhth respect to environmental qualification of safety-related electrical equipment, the Comnission determined that the provisions of the two staff documents - the Division of Operating Reactors "Guidelines for Evaluating Environmental gualification of Class lE Electrical Equipment in Operating Reactors" (DOR Guidelines) and NUREG-0588, "Interim Staff Position on Environmental gualification of Safety-Related Electrical Equipment," December 1979 "form the requirements which licensees and applicants must meet in order to satisfy those aspects of 10 CFR Part 50, Appendix A General Design Criterion (GDC-4), which relate to envi-ronmental qualification of safety-related electrical equipment." The Comoission directed, for replacement parts in operating plants, "unless there are sound reasons to the contrary, the 1974 standard in NUREG-0588 will apply." The Commission also directed the staff to complete its 1
review of the information sought from licensees by Bulletin 79-01B and to complete its review of environmental qualification of safety-related electrical equipment in all operating plants, including the publication of Safety Evaluation Reports, by February 1, 1981. The Commission 1
Bulletin 79-01B was not sent to licensees for plants under review as part of the staff's Systematic Evaluation Program. The information sought by Bulletin 79-01B was requested from these licensees by a series of letters and meetings during the months of Februaryi and March, 1980.

The Coranission requested the staff to, "keep the Comnission and the public apprised of any further findings of incomplete environmental qualification of safety-related electrical equipment, along with corrective actions taken or planned,"
and requested the staff to provide bi-monthly progress reports to the Conti ssion.
The Commission further directed the staff to add certain documentation requirements to each license after the specific requirements were approved by the Comnission. The Commission also pointed out that the various deadlines imposed in its Order, "do not excuse a licensee from the obligation to modify or replace inadequate equipment promptly."
The information developed during this proceeding emphasizes the importance of adequate documentation, the prompt completion of the review of environ-mental qualification of safety-related electrical equipment, and the prompt completion of any plant modification needed to assure conformance with the DOR Guidelines or NUREG-0588. A significant aspect of this review is the timely submittal of environmental qualification information by the operating plant licensees to enable the staff to complete its review in accordance with the Comnission's Order. The staff has a program presently underway to reevaluate, using the DOR Guidelines and NUREG-0588, the qualifications of safety-related electrical equipment exposed
to environments that may exist following postulated accidents. These accidents are Loss of Coolant Accident and Yiain Steam Line Break inside containment, and High Energy Line Breaks inside and outside containment.
In this connection the licensee was requested by ISE Bulletin 79-01B dated January 14, 1980 to provide a detailed review of the environ-mental qualification of Class lE electrical equipment. This review was to include all equipment required to function under postulated accident conditions,.both inside and outside the primary containment, and recognize all conditions specified in the bulletin. Evidence of qualification together with methods and justification, was requested.

Timely completion of the staff's review of environmental qualification of electrical equipment and timely completion of needed modifications by the licensee is required to provide continuing reasonable assurance of public health and safety. Such completion is dependent on the prompt receipt of a complete response by the licensee to the staff's requests for information.
However, the licensee's response, to date, is incomplete.
Therefore, I have concluded that the public health, safety, and interest require that a firm schedule for the timely submission of all the information previously requested by the sta f should be established by Order effective immediately.
Accordingly, pursuant to the Atomic'Energy Act of 1954, as amended, and the Commission',s.regulations in 10 CFR Parts 2 and 50, IT IS ORDERED THAT EFFECTIVE INi~iEDIATELY Facility Operating License 'No. DPR-67 is hereby amended to add the following provisions:
"Information which fully and completely responds to the staff's request as specified above, shall be submitted to the Director, Division of Licensing by the licensee not later'han November 1, 1980."
An earlier response is encouraged to facilitate staff review and issuance of the safety evaluation report. The licensee or any person whose interest may be affected by this Order may request a hearing within 20 days of the date of this Order. Any request for a hearing will not stay the effective date of this Order. Any request for a hearing shall be addressed to the Director, Office of Nuclear Reactor Regulation, U.S.
Nuclear Regulatory Commission, Hashington, D. C. 20555. A copy of the request should also be sent to the Executive Legal Director, U. S.
Nuclear Regulatory Commission, Washington, D. C. 20555, and to Robert Lowenstein, Esq., Lowenstein, Newman, Reis and Alexrad, 1025 Connecticut Avenue, N. M., Washington, D. C. 20036, attorney for the licensee.
If a hearing is held concerning this Order, the issue to be considered at the hearing shall be whether the license should be modified to require submission, of information as set forth in Section IV. of the Order.
Operating of the facility on terms consistent with this Order is not stayed by the pendency of any proceedings on the Order.
