Gentlemen:

By Order of November 6, 1979, the Board granted a joint motion of Applicant, NRC Staff and the Department of Justice to suspend discovery activities from November 1,

1979 to January 2, 1980, so that the parties could continue settle-ment negotiations.

Florida Power

& Light Company (FPL) is pleased to inform the Board that FPL and the Orlando Utilities Commission have agreed in principle on a settlement which resolves all matters at issue in this proceeding between FPL and the Orlando Utilities Commission.

The documents which embody this settlement are being drafted, and it is expected that they will be executed in the near future.

FPL, the Department and Staff have held extensive settlement discussions during this suspension in discovery.

These parties have made progress in narrowing their dif-.

ferences, but have not been able to reach an agreement which would resolve the issues in this proceeding.

Page Two December 21, 1979 of this, Applicant, Staff and the Department agree that no further suspension of discovery activities is appropriate.

Finally, FPL respectfully requests that the Board allow the parties until January 18, 1980, to present the Board with a proposed schedule for further proceedings.

The Staff and the Department of Justice have authorized counsel for FPL to state that they have no objection to the January 18 date.
