intensive settlement negotiations have been conducted between Florida Power

& Light Company

("FP&T"), the Justice Department, the NRC Staff and the Cities.

These negotiations continue.

However, with the exception of the Orlando Utilities Commission

("Orlando" ), at this time I cannot represent that there is sufficient likelihood that settlement will be reached between FP&L and intervenors other than Orlando to justify continued suspension of discovery.

Florida Cities support fully the desirability of settlement and intend to continue negotiations while d iscove y is in prog ress, so long as there is any hope tha t there can be settlement.

Ho~ever, there is, of course, a

balance between encourag ing settlement and avoiding unnecessary delay" of proceed ing s.

The Cities and their Counsel are regretful to be forced to g ive such report, but under the circumstances, they respectfully request either "that the Board order that the parties recommence discovery or, in the alternative, that it call a prehearing conference to assess the situation.
