(St. Lucie Plant, Unit No. 2)

JOINT MOTION OF APPLICANT, DEPARTMENT OF JUSTICE AND STAFF FOR SUSPENSION OF DISCOVERY PROCEEDINGS By Order of July 19, 1979.the Atomic Safety and Licensing Board granted an extension in discovery activities in the above captioned proceeding until November 1, 1979 so that the parties cou1d continue settlement negotiations.

Although no settlement has yet been

reached, the Applicant, the Department of Justice and Staff believe that good progress has been made towards a

settlement and that further negotiations are warranted.

In order to avoid disruption of negotiation activities and to preclude unnecessary

expenses, Applicant, the Department of Justice and Staff respectfully request that the Board grant an additional extension until January 2, 1980 to suspend discovery activities while the parties continue negotiations.

Counsel for Florida Cities has not had the opportunity to confer with his clients concerning this requested extension and accordingly does not join in this motion.

Florida Cities are assessing the situation and will

respond separately.

However, they have no objection to an interim short extension beyond the November 1, 1979 date pending their assessment.
