20555 Gentlemen:

This letter is in reponse to your Memorandum and Order of April 5, ]979 ALAB-537 requesting that certain information be filed by the Staff with-in 45 days from the date of that opinion.

We calculated that date to be Hay 21, 1979.

The Staff witness most familiar with the St. Lucie case and the one which the Staff intends to rely upon for preparation of the requested testimony is currently stationed at Three Nile Island.

He is expected to return around Nay 1, 1979.

His absence makes it impossible for the Staff to begin preparation of the information requested by ALAB-537.

Moroever, the uncertainties associated with the situation at Three Nile Island precludes absolute assurance that the Staff witness will return by Nay 1, 1979.

The Staff proposes to reassess its position sometime in the latter part of April and will advise the Board at that time of the nature of our requested continuance.

As a matter of information, our Staff witness believes that the job required by ALAB-537 will take 45 days from the date he returns.

In any event, it appears, that the Staff would not be prepared to present its testimony until June'. 15, 1979 or later.

tp We will keep the Board and the parties advised.
