PROPOSED IMPOSITION OF CIVIL PENALTY - $37,500 This is to inform the Co11111ission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of.$37,500 will be issued on or about November 28, 1990 to the Commonwealth Edison Company.
This action isbased on the licensee 1 s failure to perform an appropriate safety evaluation in accordance with 10 CFR 50.59 prior to its use of a temporary pump in conjunction with its containment air sampling systeri1.
It should-be noted that the licensee has not been specifically informed* of.the enforcement action. The schedule of issuance and notification is:
Mailing of Notice Telephone Notification of Licensee The State of Illinois will be notified.
November 28, 1990 November 28, 1990 The licensee has thirty days from the date of the Notice in which to respond.
Following NRC evaluation of ttie response, the civil penalty may be remitted, mitigated, or imposed by Order.
