PROCEDURE FOR IMPLEMENTING THE 15 YEAR MATERIALS LICENSES TERM On June 8, 2015, the Commission issued Staff Requirements Memorandum (SRM)-SECY 0015, Project Aim 2020 Report and Recommendations. In the SRM, the Commission directed the staff to perform a prioritization of all work activities across the agency, and a one-time re-baselining of this work. The Commission noted that the staff should prioritize and re-baseline the agencys work in an integrated manner consistent with the agencys mission, values, and the Principles of Good Regulation.
On January 31, 2016, the staff submitted to the Commission SECY-16-0009, Recommendations Resulting from the Integrated Prioritization and Re-Baselining of Agency Activities. Enclosure 1 to the SECY (ML16028A212) includes a list of 151 work activities that can be shed, de-prioritized, or completed with fewer resources. This list is also referred to as the C-List. The majority of the items were completed within 6 months of the issuance of the SRM, while the remaining were to be completed within 12 or 18 months of the issuance of the SRM. On April 13, 2016, the Commission issued SRM-SECY-16-0009 that approved the staffs recommendations with exception of Item 6, delaying the Dodd-Frank Rulemaking.

2 The Office of Nuclear Material Safety and Safeguards staff was tasked to address and implement Item 37 of the C-List by October 13, 2017, which consisted, in part, to standardize a 15 year materials license term in lieu of the current 10 year term. In August 2016, an U.S.
Nuclear Regulatory Commission (NRC)/Agreement State Working Group (WG) was formed to (1) develop a proposed process for extending license terms from 10 to 15 years; (2) identify all relevant affected guidance that will need to be updated; and to (3) recommend an implementation plan. The WGs final report can be found under the NRCs Agencywide Documents Access and Management System under accession number ML17151A426.
The attached procedure was developed to establish the process to implement the WGs recommendation. The procedure establishes the methodology and approach to be taken for implementing the 15 year expiration license term.
Effective October 1, 2017, each Region and Headquarters shall issue new and renewal materials licenses with a 15 year license expiration term. Please direct any questions or comments to the point of contact for this document.

Enclosure PROCEDURE FOR IMPLEMENTING THE 15 YEAR MATERIALS LICENSES TERM Objective: To establish a process to implement the standardization of a 15 year materials licenses term in lieu of the current 10 year term.
Purpose:
To provide guidance to staff in the Division of Material Safety, State, Tribal, and Rulemaking Programs (MSTR) in the Office of Nuclear Material Safety and Safeguards (NMSS) and the Division of Nuclear Materials Safety in Region I, III and IV for implementing the standardization of a 15 year license tem in lieu of the current 10 year term.

Guidance: This procedure contains the process to standardize the materials licenses to a 15 year license term in lieu of the current 10 year term. The procedure includes the following sections:

Expiration Dates Shorter Than 15 Years (Section D)

Below in detail are all the specific sections listed above.
A. Expiration Dates for New Licenses Effective October 1, 2017, all new licenses should be issued with a 15 year license expiration term. Currently, Web Based Licensing (WBL) is coded with an automatic 10 year license expiration term. When issuing new licenses, license reviewers should manually* change the expiration date in WBL. To change the expiration date, the license reviewer should follow the next steps:
(1) Enter Milestone 22 in the Milestones Tab Note: When Milestone 22 is entered, WBL will automatically generate the Expiry Date (10 years from the Milestone 22 date (always the last day of the month)).
(2) In the Information Tab, Dates section, change the date in the Expiry Date field to add an additional 5 years and click the Save button.
For example: If the Expiry Date in the field is 12/31/2025, it shall be changed to 12/31/2030.
(3) The reviewer can proceed to generate the license from WBL.
- NOTE: NMSS staff is currently working with the contractor to change the systems code to automatically generate the expiration date in WBL. Currently, WBL automatically generates the expiration date on a 10 year term. NMSS staff will issue a new revision on this procedure when the change in code has been made.
2 B. Expiration Dates for License Renewals Effective October 1, 2017, all renewal licenses should be issued with a 15 year license expiration term. Currently, WBL is coded with an automatic 10 year license expiration term.
When issuing license renewals, license reviewers should manually* change the expiration date in WBL. To change the expiration date, the license reviewer should follow the next steps:
(1) Enter Milestone 22 in the Milestones Tab Note: When Milestone 22 is entered, WBL will automatically generate the Expiry Date (10 years from the Milestone 22 date (always the last day of the month)).

C. Expiration Dates for License Amendments License term extensions can only be reviewed and authorized though license amendments if it is requested by the licensee. The following items should be followed for extending the license expiration date by 5 years.
A request to formally extend the expiration date by 5 years through a license amendment should be made only by the licensee.
The license reviewer cannot extend the expiration date of a license without a formal written request from the licensee.
D. Expiration Dates Shorter Than 15 Years The use of license authorizations shorter than 15 years can be used only on a case-specific basis. NRC management must approve all license authorizations that are shorter than 15 years. The following are some examples of conditions that may exist for licenses issued for shorter than 15 years:
New Technology: The license authorizes a new high-risk technology that the industry, the particular licensee, or NRC has not had extensive experience in using or regulating.
Early Termination: In the case that early license termination is expected after renewal.
Possession and Storage Only and Possession and Storage in Standby licensees may be renewed every 2 years and decommissioning issues will be addressed at that time. To make this determination, the Regions should the guidance provided by NMSS in Policy and Guidance 1-27, Reviewing Requests to Convert Active Licenses to Possession Only Licenses (ML003685598), and memorandum dated January 19, 2005, Standardized Language for Authorized Use Condition on Materials Licenses Requesting Possession-Only License Status (ML050140213).
E. Other Related Tasks
- 1. NUREG-1556, Volume 20, Guidance about Administrative Licensing Procedures, (currently under review) will be revised to include the new license term of 15 years.
