Miller, Chief L1 cense Fee Management Branch, ADM EXEMPTION FROM FEES FOR STATE OF SOUTH CAROLINA PATRIOTS POINT DEVELOPMENT AUTHORITY By application dated June 16, 1981, as suppl~nented by letters dated July 16, July 29 and August 5, 1981, the Maritime Administration of the U. S. Department of Commerce requested an amendment to Facility License No. NS-1 *. The amendment was to add the State of South Carolina Patriots Point Development Authority as co-licensee with the Maritime Administration for the possession, but not oper-ation, of the nuclear reactor aboard the Nuclear Ship SAVANNAH.
On July 14, 1981, the State of South Carolina Patriots Point Development Authority entered' into an agreement (by way of a Bareboat Charter-Contract No. MA-10225) with the
- U. S. Department of Comnerce to lease the N. S. SAVANNAH to the Authority for use as a stationary public museum exhibit. The vessel would be on display as part of the Authority's Maritime and Naval Museum 1n Mt. Pleasant, South Car-olina. Long range plans for the vessel are stated to include activation of the passenger accorrmodat ions and a restaurant aboard it. Under.the agreement, the Authority has leased the facility for a five-year period with renewal options.
Ownership.of the N.S. SAVANNAH was retained by the Department of Corrmerce, Maritime Administration.
The N.S. SAVANNAH was designed and built as a nuclear powered merchant ship that used a pressurized water reactor designed to operate at a maximum of 80 MWt.
The reactor was shutdown in November.1970 and ~ll reactor fuel has been removed from the ship. The remaining radioactive material is primarily the activated pressure vessel and components in the pressure vessel (see NRR's Safet1 Evaluation Report issued with Amendment No. 9 to the license on.August 14, 1981)*
Although the provisions of 10 CFR 170.11 *routinely exempt F.ederal Government agen-cies*(such as the Maritime Administration under the U.S. Department of Transpor-tation--formerly the U. S. Department of Corrmerce) from the fee requirements of Part 170 when the facility is not designed to produce electrical or heat energy for corrmercial sale, the regulations dp not exempt an agency of the State for such a facility.
On this basis, it is necessary that the records reflect our fee posi-tion for the State of South Carolina Patriots Point Development Authority as co-licensee with the Maritime Administration.
Based on discussions with Pete Erickson (former Project Manager for the N.S. SAVANNAH), it is our understanding that the Patriots Point Development Authority is a non-profit, state-supported and legis-lated,. agency of the State of South Carolina.

APR 0 1 1983 Based on the follo~ing, an exemption pursuant to 10 CFR 170.ll(b) is justified and is hereby granted for any applications for past and future approvals for the State of South Carolina Patriots Point Development Authority as a co-li-censee for possession, but not operation, of the defueled nuclear reactor.

This exemption includes exemption from the inspec-tion provisions of 10 CFR 170.23.

While the Authority is co-licensee on a Part 50 license issued for the nuclear power reactor aboard the SAVANNAH, the co-licensing is only required because the activated components of the defueled reactor are still on board the ship. Therefore, in order for the Authority to use the SAVANNAH as part of their public museum exhibit, they must be auth-
- orized pursuant to Part 50, to possess but not operate the defueled reactor which is. on board the ship.

The Authority is comparable to a non-profit educational institution in that it is state legislated and supported and is using the SAVANNAH for
- exhibition rather than for any comnercial or operative use of the reactor that is on board the ship.*
We estimate that the exempted amount over a five-year period will be approx-imately $8,825 based on one amendment per year with three of them being Class III {$12,000) and two being Class II ($2,400) and one $650 inspection fee per year (5 x $650 = $3,250). This split between the Maritime Administration and the Authority amounts to $8,825 each.* Since August 14, 1981, only one amend-ment has been issued (on February 2, 1983, Amendment No. 10 was issued to re-flect the transfer of the Maritime Administration from the Department of Com-merce to the Department of Tr~nsportation_).
