SETTLEMENT OF PROCEEDING ON ORDER IMPOSING* CIVIL MONETARY PENALTY By EN-80-SOA, dated February 23, 1981, the Cammi ssion was infonned that an Order Imposing a Civil Penalty in the amount of Forty Thousand Dollars had been issued to Corrnonwealth Edison Company.

This action was based on an alleged violation which involved inattention to duties by licensed operators while assigned at the controls of Dresden Unit 3 reactor on August 8, 1980.

In a letter of March 19, 1981, the 1 i censee requested a hearing in -accordance with the terms of the February 23rd Order and 10 CFR 2.205.

On the basis of reconsideration of the applicable evidence, regulatory requirements, and policy,.IE and Commonwealth Edison Company reached agreement whereby the civil penalty is mitigated from $40,000. to $18,000, and Corrtmonwealth Edison Company will pay the $18,000 mitigated penalty and withdraw its March 19, 1981 request for a hearing.

Accordingly, "Settlement of Proceeding on Order Imposing Civil Monetary Penalty_"

will be issued on June 10, 1981.

Since :his. action involves mitigation of an imposed penalty, a press release will be made.
