The Notice of Violation concerned violat~n of~

10 CFR 50.54(k) in that licensed operators for Dresden Units 2 and 3 were observed by the NRC resident inspector to be apparently asleep at the controls and thus not fully attentive nor able to monitor reactor conditions.

In a November 24, 1980 letter, the licensee denied noncompliance with NRC regul~tions.

After consideration of the licensee's basis for denial, no new facts were found to justify mitigation of the civil penalty.

Accordingly, a civil penalty of

$40,000 was imposed on the licensee by letter dated Februury 23, 1981.

Under the terms of the Order, the licensee may, within 25 days of the Order, pay the civil penalties or request a hearing.
