May 26, 1995 EN 95-036 OFFICE OF EN~ORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee:

Commonwealth Edison Company Dresden Station.- Units 2 and 3 Docket No. 50-237; 50-249 (EA 95-074)

Subject:

PROPOSED EXERCISE OF ENFORCEMENT DISCRETION This is to inform the Commission that the staff intends to exercise enforcement discretion per Section VII.B.6 of the Enforcement Policy and not issue a NotiG~ of Violation for a potential Severity Level III violation. A letter on the subject will be issued on or about June 2, 1995, to the Commonwealth Edison Company (Dresden Station, Units 2 and 3). The action is based on the licensee's identification of a significant contaminated material control problem consisting of the discovery of approximately 450 uncontrolled, contaminated items found outside of radiologically protected areas. Although these items all had very low levels of contamination, and were of minimal safety significance, this problem was of regulatory concern because of the large number of items that was uncontrolled.

The exercise of enforcement discreti-0n for this apparent Severity Level III*

violation is warranted primarily becau'se of the licensee's prompt and comprehensive response to the violations after four uncontrolled items were discovered by roµtine surveys. _ Th'.i'OS'~':r.esponse,:co.riststed' *of an extensive site-wide survey, undertaken to determine the scope and magnitude o~ the uncontrolled item contamination, and the subsequent actions taken to prevent the future recurrence of contaminated material control issues.

It should be noted that the licensee has not been specifically informed of this action.

The schedule for issuance of the letter and notification is:

No response to the letter is required but the licensee has requested a meeting with regional staff to discuss its efforts to improve performance in this area.
