PROPOSED IMPOSITION OF CIVIL PENALTY - $ 75,0bb This is to inform the Commission that a Notice of Violation and Proposed Impo§iti6n of Civil Pena1ty in the afuount of $ 75~Doo will be issued on or about May 17, 1994 to the bommonwealth Edison ~9mpany. This action is based on recurrent failures of Yarway reactor water level instruments used to actuate emergency core cooling systems.
The violations were characterized as a Severity level III problem whith has a base c1vil penaity_of $50,000. A tivil penalty of $75,000 ha~ been ~roposed.
- There was escalation for NRC identifitation which was offset ~y mitigation for corrective actions.
Discretion was used to ~scalate only so percent, instead of 100 percent, for licensee prior poor performance, to recognize licensee organization changes and evidence of recent performance imprdVemehts.
It should be noted that the licensee has not been specifically informed of the enforcement_attion.
The schedule of issuance and notification is:

The licensee has thirty days from the date of the Notice in which to respond.
Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
