The base civil penalty for a Severity Level III problem is $50,000. After considering the escalation and mitigation factors of the Enforcement Policy, an overa.11 reduction of 50 percent of the base civil penalty was deemed appropriate. The 50 percent.

mitigation was arrived at by partially. offsetting 100% mitigation for licensee identificatfon and corrective actions with 50% escalation for past performance~

It should be noted that the licensee tias not been specifically informed of the enforceinent action.* The schedule of *issuance and ntitiffcation is:
