PROPOSED IMPOSITION OF CIVIL PENALTY - $25,000
- This is to inform the Co~ission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $25,000 will be issued on or
- about December 17, 1991 to Commonwealth Edison Coinpany. This action is based on violations that resulted in th.e unplanned exposure to radiation of workers engaged in inspection activities in the Unit 3 drywel L While
~either worker recei~ed ~ radiatibn dose in exiess of NRC limits, the *
- numerous violations* involved in the event represented a breakdown in oversight*
bf work in the radiological controls area~ The violations have cumulatively.
been classified as a Severity Level III problem.
The base civil penalty for a Severity Level III problem is $50,000. After considering the escalation and mitigation factors of the Enforcement Policy, an overa.11 reduction of 50 percent of the base civil penalty was deemed appropriate. The 50 percent.
mitigation was arrived at by partially. offsetting 100% mitigation for licensee identificatfon and corrective actions with 50% escalation for past performance~
It should be noted that the licensee tias not been specifically informed of the enforceinent action.* The schedule of *issuance and ntitiffcation is:
