e NOTICE OF VIOLATION C&D Charter Power Systems, Incorporated Blue Bell, Pennsylvania Docket No.:
99901304 During an NRC inspection conducted on September 16 through 18 and October 7
through 9,
- 1996, a violation "of NRC requirements was identi fied, In accordanc~
with the "General Statement rF Policy and Procedure for NRC Enforcemer.t Actions," NUREG-1600, the bio. tion is listed below:
Seciion 21.21, "Notification of failure to comply or existence of a defect and its evaluation," of 10 CFR Par't 21 requires, in part, that a dedicating entity is responsible for maintaining auditable records for the dedication process.
- Further, Section 21.3, "Definitions," of 10 CFR Part 21 requires, in part, that in all cases, the dedication process must be conducted in accordance with the applicable provisions of 10 CFR Part 50 Appendix B.
Contrary to the above, C&D did not establish and maintain auditable records for the dedication process used to dedicate battery cells destined for Class 1E safety-related station battery applications.
Adequate objective evidence was not provided to indicate that C&0's battery cell dedication process was being conducted in accordance with the applicable provisions of Appendix B to 10 CFR Part 50.

Document Control Desk, washington D.C. 20555-0001, with a copy '.o the Chief, Special Inspection Branch, Division of Inspection and Support
- Programs, Office of Nuclear Reactor Regulation, within 30 days of the date of the letter transmitting this Notice of Violation.
This reply should be clearly marked as a "Reply to a Notice of Violation" and should include for each violation:
(1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results
- achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved.
