REQUEST FOR WITHHOLDINGINFORMATIONFROM PUBLIC DISCLOSURE-SUSQUEHANNA STEAM ELECTRIC STATION (SSES), UNIT 1 (TAC NO. M99481)
Dear Mr. Byram:
By your application dated February 2, 1998, you submitted a revision to the bases for proposed Amendment No. 209 to License NPF-14 for SSES, Unit 1, and a response to NRC's request for additional information, PLA-4841, and Siemens Power Corporation (SPC) affadavit dated January 30, 1998, executed by Mr. H. D. Curet, and requested that it be withheld from public disclosure pursuant to 10 CFR 2.790.
SPC stated that the Figure 1 and the associated ATRIUM'-10CHF test data included in Response to Question 3 in Attachment 1 to PLAA841 should be considered exempt from mandatory public disclosure for the following reasons:

The document contains the information which is vital to a competitive advantage of SPC and would be helpful to competitors of SPC when competing with SPC.
The information is considered to be proprietary by SPC because it reveals certain distinguishing aspects of SPC licensing methodology which secure competitive advantage to SPC.
The disclosure of the information would permit the competitor to reduce its expenditure of money and manpower and to improve its competitive position by giving it valuable insights into SPC licensing methodology and would result in substantial harm to the competitive position of SPC.

This information is held in confidence by SPC and is not publically available.
SPC policy requires that proprietary information be kept in a secured file or area and distributed on a need-to-know basis.
We have reviewed your application and the material in accordance with the requirements of 10 CFR 2.790 and, on the basis of your statements, have determined that the submitted information sought to be withheld contains proprietary commercial information.
Therefore, Figure 1 and the associated ATRIUM'-10CHF test data included in Response to Question 3 in Attachment 1 to PLAC841, marked as proprietary, willbe withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

Ifthe need arises, we may send copies of this information to our consultants working in this area.

Ifthe basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC. You also should understand that the NRC may have cause to review this determination irr the future, for example, ifthe scope of a Freedom of Information Act request includes your information.
In all review situations, ifthe NRC makes a determination adverse to the above, you willbe notiTied in advance of any public disclosure.
