PROPOSED IMPOSITION OF CIVIL PENALTIES - $210,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalties in the amount of $210,000 will be issued on or about June 20, 1997, to the Pennsylvania Power 8 Light Company for violations at its Susquehanna facility. The action is based on:

(1) a Severity Level II problem involving an inoperable emergency diesel generator, the failure to follow procedures, inadequate procedures, and incomplete and inaccurate information, and (2) a Severity Level III violation involving an inoperable containment isolation valve.

In accordance with the Enforcement Policy, a base civil penalty in the amount of $80,000 was considered for the Severity Level II problem and a base civil penalty in the amount of $50,000 was considered for the Severity Level III violation. Although the licensee identified and corrected the violations associated with the Severity level II problem (thereby fully mitigating the penalty under the normal civil penalty assessment process),

the staff decided to exercise discretion in accordance with Section VII.A.1 of the Enforcement Policy and propose a civil penalty at two times the base amount.

Discretion was warranted because of the particularly poor licensee performance in this case, as evidenced by (1) the nature of the violations associated with the Severity Level II problem, (2) the extensiveness of the problem with inaccurate records; and (3) the management and supervisory failures demonstrated by these violations.

With respect to the Severity Level III violation, although the licensee's corrective actions were prompt and comprehensive, the staff is proposing a $50,000 civil penalty because the NRC identified the violation.

It should be noted that the licensee has not been specifically informed of the enforcement action.

The schedule of issuance and notification is:

Mailing of Notice Telephone Notification of Licensee June 20, 1997 June 20, 1997 The State of Pennsylvania will be notified.

The licensee has thirty days from the date of the Notice in which to respond.

Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
