PROPOSED IMPOSITION OF CIVIL PENALTY -
$ 100,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $ 100,000 will be issued on or about February 9,
1996, to Pennsylvania Power
& Light Company (PP&L).
The action is based on a Secretary of Labor's Decision and Order of Remand, dated October 20, 1995, finding that PP&L discriminated against an employee on its security staff after the employee engaged in protected activities.
A letter is also being sent to the employee's supervisor who was found by the Secretary of Labor to be responsible for the adverse action against the employee.
The letter to the supervisor does not include an.enforcement sanction due to the significant disciplinary actions already taken against him by the licensee.
The protected activity was reporting of alleged cheating on a security requalification examination proctored by the supervisor for which earlier enforcement actions against the licensee (EA 94-212, Severity Level III Notice of Violation) and the supervisor (IA 95-011, Severity Level III Notice of Violation) were issued.
It should be noted that the licensee has not been specifically informed of the enforcement action.
