UNITED STATES NUCLEAR REGULATORY COMMlSSlON WASHINGTON, D.C. 205554001 October 26, 1995 Mr. Robert G.

Byram

'enior Vice President-Nuclear Pennsylvania Power and Light Company 2 North Ninth Street Allentown, PA 18101

SUBJECT:

REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE, SUSQUEHANNA STEAN ELECTRIC STATION, UNITS 1

AND 2 (TAC NOS.

M91663 AND M90666)

Dear Mr. Byram:

By letter dated June 8,

1995, Pennsylvania Power

& Light Company (PP&L) submitted two General Electric Company reports specific to Susquehanna Steam Electric Station (SSES) in support. of its proposals, and requested that the reports be withheld from public disclosure pursuant to 10 CFR 2.790.

These :

proposals included MDE-79-0485, "Technical Specification Improvement Analysis for the Reactor Protection System for Susquehanna Steam Electric Station, Units 1 and 2," and RE-022, "Technical Specification Improvement Analysis for the Emergency Core Cooling System Actuation Instrumentation for Susquehanna Steam Electric Station, Units 1

& 2."

General Electric Company's affidavit executed May 30, 1995 by George Stramback, stated that the submitted information should be considered exempt from mandatory public disclosure for the following reasons:

The reports contain information which, if used by a competitor, would reduce his expenditure of resources or improve his competitive position in the design, manufacture, shipment, installation, assurance of quality, or licensing of a similar product.

2.

The reports include information which reveals aspects of past,

present, or future GE customer-funded development plans and programs, of potential commercial value to GE.

We have reviewed your application and the material in accordance with the requirements of 10 CFR 2.790

and, on the basis of General Electric's statements, have determined that the submitted information sought to be withheld contains proprietary commercial information.

Therefore, GE reports MDE-79-0485, "Technical Specification Improvement Analysis for the Reactor Protection System for Susquehanna Steam Electric

Station, Units 1 and 2," and RE-022, "Technical Specification Improvement Analysis for the Emergency Core Cooling System Actuation Instrumentation for Susquehanna Steam Electric Station, Units 1

& 2," marked as proprietary, will be withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

In addition, non-proprietary versions of these documents are being placed in the public document room.
