NOTICE OF VIOLATION (IA 95-011)
This is to inform the Commission that a Notice of Violation will be issued on or about Hay 9, 1995, to an unlicensed individual who was the former security shift supervisor (SSS) at Susquehanna Steam Electric Station.
The action is based on an investigation conducted by the Office of Investigations and an enforcement conference conducted between the staff and the former SSS.
A Severity Level III violation will be issued involving the former SSS deliberately submitting to the licensee information that he knew to be incomplete and inaccurate in some material respect.
Specifically, after noting that a number of individuals answered a particular question incorrectly on a security examination that he proctored, the former SSS retaught the information pertinent to that question, provided an opportunity to change the answers by returning the answer sheets to the individuals who had the incorrect answer, and then submitted the changed or corrected examinations as the initial results for grading.
A Severity Level III violation is also being issued to the Pennsylvania Power and Light Company.for..failure to maintain complete and accurate records as required by its Guard Training and gualification Plan.
No civil penalty is proposed because application of the adjustment factors resulted in full mitigation of the civil penalty for the violation issued to the licensee.
It should be noted that the individual has not been specifically informed of the enforcement action.
The schedule of issuance and notification is:
Hailing of Notice May 9, 1995 Telephone Notification of Licensee and individual Hay 9, 1995 The State of Pennsylvania will be notified.
The individual has thirty days from the date of the Notice in which o
respond.
