Mr. Davenport and I are concerned for our communities and our citizens. We believe the NRC is putting constituents at risk. The issues we introduced October 2016 continue today, they have not gone away. We need your help to reconcile and clarify each one through open hearings. We respectfully request these hearings to be held in the ten-mile Plume Exposure Zone or the fifty-mile Ingestion Pathway Zone of SSES 1 and 2.

We applaud President Trumps budget. We understand he included funding for Yucca Mountain nuclear waste repository and plans to use these funds for the management of nuclear waste storage. Talen Energy 2018 plans called for expanding nuclear waste storage at SSES 1 and 2. Please ensure that Yucca Mountain nuclear waste repository becomes a reality, and that SSES 1 and 2 do not become a waste dump.

Mr. Davenport would like to make it clear that he hasnt been able to review or read the Salem Township zoning law in total that applies to nuclear waste, PA Zoning class Nuclear Waste 4, Chapter 236, enacted march 28, 1995, Amended September 23, 1997, Amended March 23, 2004, Salem Township Board of Supervisors, http://elibrary.pacounties.org/Documents/luzerne/795. However, most of the information available through attendance at the zoning hearing board meeting on the subject implies we are dealing with hazardous substances, high-level waste (HLW) or used nuclear reactor fuel that resides within one-half mile of our streams, major water ways, and wells that are used for drinking water.

Mr. Davenport reports, Some people may not be aware, Salem Township Changed the zoning of the nuclear power plant and the land they own to a new zoning called Nuclear 4 under the provision regulated waste. This along with some new federal laws, he believes, allows for the permanent storage of nuclear waste on site. He further states, There has also been the suggestion that nuclear waste from other areas may be moved to SSES 1 and 2 for storage.

Congress was considering the closing of Yucca Mt. and limiting total storage space available. This position is unacceptable. We estimate the waste storage space requirements for SSES 1 and 2 to be 300,000 metric tons of waste. This waste is equivalent in size to the weight of the Empire State Building. Mr. Davenport and I wish to combat local nuclear waste storage at SSES 1 and 2 thus stopping our community and surrounding area from becoming a permanent nuclear waste dump. We need more ideas from you, our representatives, and a lot of help from communities around the country if we are going to stop this travesty. Please ensure that Yucca Mountain nuclear waste repository becomes a reality.

Attachment 1 The NRC noted, in past response, that Mr. Monatesti did not comply with their regulations; hence, the NRC denied him any standing regards the transfer of license of SSES 1 and 2 during the sale of Talen Energy to Riverstone Holdings LLC.

Refusal to hold open hearings in our area regarding NPP SSES 1 and 2 license transfer, denying Citizen right to Due Process, Due Process Clause, Fifth and Fourteenth Amendment, is unethical and inconsistent with our oversight as citizen. The outstanding issues include:

Failure to invoke Executive Order 12,898 and Title VI along with section 311 of the Stafford Act, EPA to include environmental justice as a factor in review of state permits pursuant to Clean Air and Clean Water Acts Planned nuclear waste storage exceeds regulatory limit in Salem Township and concern regarding the distribution and handling of nuclear waste throughout the Continental United States, 102 NPP US sites to host 300,000 metric tons of waste and numerous DOD facilities with unknown amounts, reference Nuclear Waste Policy Act, March 2004, page 42 Ethical lapse by NRC/Talen Energy LLC regarding their handling of Salem Township, Planning Board Meeting and citizen participation, misrepresented jurisdiction argument regarding health and safety issues Business operations planning misrepresentations by Riverstone Holdings LLC, Talen Energy and the NRC, regarding investment and decimating of resources and facilities where profit might be impacted Possible misrepresentation of fact on Securities and Exchange Commission 10K regarding profit and loss, $700 Million concurrent risk, along with altering potential investments (adjustments) in area power generation technology and facilities following commitment of licensing given Talen CEO, CIO and CFO had prior knowledge of capital investment decisions Potential RICO Act 109, causality, violations by Talen Energy LLC personnel, executive payoff of $25 Million severance at deal close after denial of planned $70 Million investment, Washingtonville Withholding of SUNSI information, thus denying citizen the opportunity to ascertain survivability and operational integrity of NPP, twenty year SSES 1 and 2 renewal license granted based on a five year business case 3
