REQUIEST FOR A TEMPORARY WAIVER OF COMPLIANCE RELATED TO SUSQUEHANNA STEAM ELECTRIC STATION, UNITS 1
AND 2 By letter dated November 29, 1990, Pennsylvania Power and Light Company (PP&L) requested a Temporary Waiver of Compliance from the requirements of Technical Specifications 3.0.4 and 4.0.4, which require certain actions'o be taken if a licensee fails to perform-surveillance requirements within the allowable time.
By letter dated November 30, 1990, PP&L followed up the request for a Temporary Waiver of Compliance with an application for a
permanent change to the Technical Specifications to correct the problem with sections 3.0.4 and 4.0.4.
PP&L indicated that, as a result of an internal audit, it recently identified that surveillance for certain instrdments related to Reactor Protection System (RPS), Control Rod Block (CRB), and Source Range Monitor (SRM) could not be performed prior to entry into an Operational Condition for which the surveillance requirements are prerequisites.
PP&L indicated that although the
.problem has existed since the two units were licensed, specific diffi'culty with RPS, CRB, and SRM instrumentation was only recently identified.
The staff has reviewed PP&L's request in light of the NRC policy governing the issuance of Waivers of Compliance.
We conclude that resolution of the problem of these surveillances requires a change to the Technical Specifications.
We also find that the proposed change doesn't meet the requirements of 10 CFR 50.91 for emergency or exigency changes to the Technical Specifications.
Since Waivers of Compliance are issued in connection with emergency or exigency changes to the Technical Specifications, PP&L's request does not qualify for such a waiver.
Accordingly, the PP&L request for a Temporary Waiver of Compliance is denied.
Notwithstanding the denial of the Temporary Waiver of Compliance, we recognize that Technical Specifications 3.0.4 and 4.0.4 impose an impractical requirement on PP&L and is not warranted to assure plant safety.
Additionally, PP&L has submitted a formal request for changes to the Technical Specifications.
Therefore, in accordance with our enforcement policy and in view of the fact that the problem was identified by PP&L and has a low safety significance, we will not exercise any enforcement action related to these surveillance requirements of RPS, CRB, and SRM temporari ly so that the planned shutdowns of Units 1 and 2 can proceed in an orderly manner during the next few days, but no later than December-15, 1990.
