) in Salem To'wnship, Luzerne County, Pennsylvani'a..

Construction Permit CPPR-101 specified Yarch 1, 1981 as the latest date for completion of construction of Unit 1

Construction Permit CPPR-102 specified September 1,

~ 1982 as the latest date for completion of construction for Unit 2.

The applicants requested that these dates be extended to December 31, 1982 for Unit 1 and f'arch 31, 1984 for Unit 2.

The applicants'equest for construction permit extensi on is contained in their'letter of January 23, 1981.

Discussion The applicants'etter of January 23, 1981, stated that the delay in the corpletion of construction of the Susquehanna Steam Electric Station, Units.

1 and 2 is due to the following factors:

Changes in the scope of the project including increases in the amount of h.aterial and engineering required resulting in part from the accident at Three hile Island Unit 2 and subsequent regulatory actions.

b.

Construction delays and lower than estimated productivity which resulted in delays in installation of material and equipment and delays in completion of systems to support plant testing.

c.

Changes in plant design d.

Delays in delivery of equipment and material e.

Shortages of certain highly skilled workers and similar construction related factor's'ased on our review of the applicants'equest, we find that the above factors were beyond the applicants'ontrol and constitute good cause for the delay. in conpletion of construction.

The applicants have maintained a construction effort at the Susquehanna site and have'revised the design of the facility to meet changino regulatory requi rements.

Based on our evaluation of the causes for the

, delay, we have determined that the requested extension is for a reasonable period of time.

As a result of our review of the Susquehanna Final Safety Analysis Report to date and considering the nature of the delays, we have identified no significant hazards considerations in connection with the extension of the construction completion date.

In addition, we find that the only change proposed by the applicants to the existing construction permits is an extension of the latest

'completion dates.

This extension will not allow any work to be performed involving new safety information of a type not considered by a. previous

-Commission safety review of the facility and that is not already allowed by the existing construction permit.

Therefore, we find that

( 1) thi s action does not inyolv'e a significant hazards consideration, (2) prior public notice of this action is not required, (3) there is reasonable assurance:that the health and safety of the public will not be endangered by extension of the construction completion date, and (4) good cause.exists for issuance of an Order extending the. completion dates.

Conclusions Accordingly, issuance of an Order extending the latest completion dates for construction of the Susquehanna Steam ETectric Station is reasonable and should be authorized.

The latest completion date for Unit I should be extended to December 31, 1982 and the lates't completion date for Unit 2 should be 'extended to 51arch 31, 1984.

The purpose of the amendments is to include Allegheny Electric Coooerative, Inc, as the owner of a 108 carnership interest in the Susquehanna Stean Electric Station, Unit No. 1

& Unit No 2.

'he have reviewed your request for amendment of Construction Permits Ho.

CPPR-101 and Ho. CPPR-102 and have concluded that Allegheny Electric Cooperative, Inc. is qualified to finance a 10% ownership interest in the Susquehanna Station.

The basis for our conclusion is set forth in the enclosed safety evaluation.

W Ne have further concluded that the activities authorized by these amendments villnot be inimical to the comvon defense and security or to the health and safety of the public and that authorization of these amendments to the permits does not involve a significant hazards consideration inasmuch as it involves no increase in the probability of an accident, no increase in the consequences of an accident, nor does it involve a decrease in the safety margins, age have a1so concluded that the amendments involve an action which is insignificant from.the standpoint P'of environmental impact and pursuant to 10 CPR Section Sl.5(d)(4) that an environ.ental impact state<rent or negative declaration and environnental impact appraisal need not be prepared in connection with the issuance of. these a1r@ndnentsI inasmuch as no changes in design, construction or ogeration are involved>

1 to CPPR-101 and Amendment No.

1 to CPPR-102 INTRODUCTION On November 2, 1973 Construction Permits Nos.

CPPR-101 and CPPR-102 were issued to Pennsylvania Power and Light Company (PP&L) for Susquehanna Steam Electric Station Units 1 and 2 (SSES), respectively.

By Application transmitted by letter dated March 2, 1977, PP8L and Allegheny Electric Cooperative, Inc.

(AE) requested that these construction permits be amended to include AE as a co-owner of SSES.

The Application states that PP8L will retain exclusive responsibility and will have absolute authority and discretion for the design, construction and operation of SSES and that AE will hold a 10 percent undivided ownership interest, pay 10 percent of all construction and operating costs and receive 10 percent of the energy output of SSES.

The details of the complete agree-ment between PPEL and AE are set forth in the "Tenancy in Common Participation Agreement for Susquehanna between Allegheny Electric Cooperative, Inc.

and Pennsylvania Power and Light Company" dated March 18, 1977.

AE is a non-profit electric cooperative corporation with 12 members serving rural areas in Pennsylvania and one member serving rural areas in New Jersey.

The Application states that AE is not owned, controlled or dominated by an alien, foreign corporation or foreign government.

AE-has agreed in writing that it will limit access to Restricted Data in accordance with the provisions of 10 CFR 50.37.

Therefore, the Staff's safety review consisted primarily of a determination of AE's financial qualifications.

ANALYSIS The Nuclear Regulatory Commission's regulations relating to the determination of an applicant's financial qualifications appear in Section'50.33(f) and Appendix C to 10 CFR Part'50.

These regulations state that there must be reasonable assurance that an applicant can obtain the necessary funds to cover the estimated construction costs of a proposed nuclear power plant and its related fuel cycle costs.

AE will finance its 10 percent ownership interest with a Federal Financing Bank Loan in the approximate amount of $250,000,000 that is guaranteed by the Rural Electrification Administration (REA).

PA 27BB Clarion was issued to AE by the REA on August 12, 1977.

Notice of the proposed loan guarantee, which is supported by the full faith and credit of the United States of America, was published by the REA on March 8, 1977 (42 Federal Register 13034).

Subsequently, on July 8, 1977 (42 Federal Register 35177) and October 25, 1977 (42 Federal Register 56349)

REA published notices that it had prepared Final Environmental Impact Statements (FES) in connection with its review of AE's application for a loan guarantee commitment.,

Each of..those.notices.indicated that.the,l,oan guarantee commitmen't is subject,to,,and,rel,ease of funds.thereunder i,s contingent

upon, REA's reaching satisfactory concl.usions with respect to its environmental effects and compliance with the National Environmental

Policy Act of 1969.

However., both.the.FES covering.the environmental impacts of SSES and the associated 230,KV.transmission facilities and the FES covering the environmental impacts of the 500 KV transmission facilities were accompanied by signed statements of the REA Administrator (dated July 1, 1977 and October 19,,1977, respectively) which declared-'n pertinent part, "It is my judgment that the proposed action by REA in providing financial assistance for a portion of the construction will be consistent with the policies set forth in the National Environmental Policy Act."

Allegheny's long-term financing is secured

.by revenues derived from the sale of electricity,to its 13 member cooperatives.

Each member cooperative is required, under the terms of a 45-year contract with Allegheny, to purchase all its electric power from Allegheny.

The rates paid by members are fixed by the Board of Directors of Allegheny and are not subject to federal or state regulatory approval.

CONCLUSION Based on the preceding analysis, we have concluded that AE has reasonable assurance of obtaining the necessary funds to finance its 10 percent ownership interest share of the construction and related fuel cycle costs of SSES.

Therefore, AE is qualified to finance a 10 percent ownership interest in SSES.

'ower an/Light Company by the Atomic Energy Commission's-Regulatory Staff authorizing constru ti.on of the Susquehanna Steam Electri.c.Station, Units 1 and2, in Luzerne County, Both Units 1 and 2 wi.ll use boiling water reactors and each will have a net. electrical output of about. 1,100,000 kilowatts.

The station will be located on a 1522-acre si.te on the west bank of the Susquehanna River, about miles southwest of Wilkes-Barre and about 5 miles, northeast of Berwick.

Xssuance of the permits on

'I follows reviews by the AEC Regulatory Staff and the Advisory Committee on Reactor Safeguards and a public hearing conducted by an Atomic Safety and Licensing Board.

The Licensing Board conducted the evidentiary-hearing on Pebruary 21 and July 24, 1973 and issued October 29 authorizing the=construction permits.

The company plans to have Unit 1 completed by the earliest and Unit 2 by September 1980.
