In reviewing material in connection with this proceeding, the HRC Staff has observed an apparent oversight with regard to-the continued viability of a contention raised by one of the intervenors.

$)ecifically, the Staff notes that on July 20, 1979, Contention 13 was expressly withdrawn by its proponent, Colleen Harsh, at page ll of "Colleen Harsh et al. Answers to First'Round IIRC Staff Interrogatories."

The Staff further notes,

however, that the Licensing Board in its "Memorandum and Order Concerning Class 9

Accident Contention" of October-19, 1979, continues to make references to this contention, thus suggesting its view that this contention remains in the proceeding.

,In light of the proponent's express withdrawal of Contention 13, the Staff suggests that the contrary is true and that Contention 13 should be recognized as having been formally withdrawn.
