Docket Nos.

50-387 50-388 NRC STAFF MOTION FOR EXTENSION OF TIME TO ANSWER APPLICANTS'OTION FOR PARTIAL

SUMMARY

DISPOSITION OF CONTENTION 17 On December 8, 1980, Applicants served "Applicants'otion for Partial Summary Disposition of Contention 17" (Motion) on the NRC =Staff.

In that Motion, Applicants move the Board for summary disposition in their favor on certain portions of Contention 17 which Applicants contend raise no genuine issues of material fact.

Thus, Applicants assert that they are entitled to a decision in their favor as a matter of law.

Consistent with the schedule established for such motions,+ the NRC Staff's answer to the Motion would be due on December 29, 1980.

One of the members of the technical staff responsible for reviewing Applicants'otion and its accompanying documentation and for preparing an gl Pennsylvania Power

& Light Company (Susquehanna Steam Electric Stations, Units 1 and 2), LBP-79-6, 9

NRC 291, 328 (1979).

affidavit in support of Staff's answer has been unavailable due to illness.

Consequently, the Staff will be unable to file an adequate answer on the above da te.

Accordingly, in order to permit development of an adequate answer to Applicants'otion, the Staff requests an extension of time until January 9, 1981 for filing its answer.

The Staff has contacted Applicants and Citizens Against Nuclear Dangers (proponent of Contention 17); neither have objected to the requested extension.

Respectfully submitted,
