The purpose of the NRC draft statement is to evaluate the potential environmental impact of the reservoir and to encourage a discussion by PP8IL and other interested parties.
The draft statement should not be interpreted as a final statement.
The NRC draft statement has been reviewed by PPSL.
On Nay 29, 1980, PP8L sent the following response to the NRC,'", "He (PPEL) are currently reviewing the design concept for the spillway and will consider the NRC's comments in this review..
As design approval for the, project will rest with the Pennsylvania Department of Environmental Resources, the design will meet their criteria.
He (PP8IL) will inform the NRC of any revisions to the spillway concept."
The Pond Hill Reservoir and its dam are being constructed because the Susquehanna River Basin Commission requires that water consumption be compensated by users during periods of low river flow.
The reset voir is not needed for the safe operation or shutdown of the nuclear power plant.
The NRC is, therefore, not reviewing the safety of the dam but rather the potential environmental impact of the construction and operation of the dam.
The NRC will complete its environmental impact review and document the results in the Final Environmental Statement scheduled for completion December 1980.

Comments on Letters to Congressmen Schweiker and Musto about
'Potential Dam Failure at Pond Hill Reservoir These letters do not, but should, put the NRC's statements in NUREG-0554 about potential dam failure at Pond Hill Reservoir in better perspective.

Pond Hill Reservoir and its dam are not being constructed because the water source is required for safe operation or l~tKi ~ of the nuclear plant but because the Susquehanna River Basin Commission requires that river." flows be supplemented by users during periods of low flow.
Because the reservoir and
'its dam are not safety-related, the NRC is not reviewing the dam's design for he purpose of approving the cLam's design, but for the purpose of evaluating the potential environmental impacts that might result from the dam's construction

However, the criteria used by the NRC in evaluating the potential environmental impacts that might result from construction and ope'ration of a non-safety-related dam are the same as those that it (and other major federal 'agencies with dam design review functions) would use in assessing and approving the design adequacy of safety-related

Because NRC disclaims design approval responsibility and authority for this dam, I suggest that the penultimate paragraph be deleted, or modified to.make clear that further. review of spillway design is being conducted solely for the purpose of determining whether our conclusions about potential dam failure would change.
Finally, I suggest that Bill Bivins, Hydrologist and NRC Dam Safety Officer, be given an opportunity to comment on the proposed letters before they are finalized and dispatched.
