Dear Ms. Perkins-Grew:

On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to Mr. David Klines letter dated November 29, 2016, (Agency Documents Access and Management System (ADAMS) Accession Number ML16335A034). Mr. Kline requested a fee waiver under Title 10 of the Code of Federal Regulations (10 CFR) 170.11(a)(1)(ii) for a future submittal of Nuclear Energy Institute (NEI) 11-08, Guidance on Submitting Security Plan Changes, Revision 1 for NRC review and potential endorsement. As explained below, I am not granting NEIs request at this time.

The NRC makes every effort to efficiently manage the agencys resources that are recovered through fees, to its licensees. In order to complete the NRC fee waiver exemption review process, the agency needs the subject document. Fee waiver exemption requests should be submitted in near proximity to the subject documents submittal date in order for the NRC to make an informed decision on the request. Based on discussions between NRC and NEI, it is my understanding that the submittal of the subject document, NEI 11-08, is not imminent. Since NEI 11-08 is not imminent, holding the review open is not an efficient use of the agencys resources. Accordingly, I am not granting NEIs request at this time. However, the NRC will consider a fee exemption request from NEI after NEI 11-08, is formally submitted to the NRC for review.

Please address any future fee exemption requests in writing to the Chief Financial Officer, as stated under 10 CFR 170.11(a)(1)(ii). If you have any questions regarding this matter, please contact Michele Kaplan of my staff at (301) 415-5256.
