NRC STAFF MOTION FOR EXTENSION OF TIME'O FILE ITS PROPOSED BRIEF AND PROPOSED FINDINGS OF FACT AND CONCLUSIONS OF LAW IN THE REOPENED SEISMIC PROCEEDINGS Thy HRC requests the Atomic Safety and Licensing Appeal Board to grant the NRC Staff an extension of time until close of business on January 6, 1980 to file the NRC Staff's proposed findings of fact and conclusions of law in the reopened seismic proceedings-now due on December 29, 1980.

Due to the press of other business during this holiday season,

however, and the fact that the NRC Staff Counsel chiefly responsible for the Diablo Canyon seismic findings has also been concurrently responsible for a major appellate brief recently filed with the Appeal Board in the McGuire/Oconee spent fuel transshipment proceeding (Docket Ho. 70-2623), the NRC Staff requests NRC 8 (1980).

On June 24, 1980, the Atomic Safety and I icensing Appeal Board ordered that the Diablo Canyon proceeding be reopened to take additional evidence on the effects of the Imperial Valley earthquake of October 15, 1979 on the Diablo Canyon seismic design.

This extension would require Pacific Gas 5 Electric Company's reply brief, if any, to be filed on January 16, 1980.

NRC Staff Counsel has been authorized to represent that the Pacific Gas 8 Electric Company, the Joint Intervenors, and Governor. Brown do not oppose the instant motion.
