I appreciate all of the hard work to resolve this long-standing open TIA and am glad to hear that we are making progress and have only a few more questions to answer to finalize the agencys position related to the off-site power system at Ginna. I was asked to provide an update to clarify the regional need related to each of the three questions contained in the original TIA. Our request at this time related to each issue is:

Question 1. Does the Ginna current licensing basis (CLB) for the offsite power system allow credit for the plant main generator voltage support to demonstrate capacity and capability of the offsite power system to permit the functioning of the required engineered safety features (ESF)? - We still need this question from the original TIA answered to allow Region I to close out a currently open URI. We have to report back whether the historical conditions was (or was not) consistent with the licensing basis at Ginna.

Question 2: Does the answer to this question constitute a change in NRC staff position previously approved in licensing actions, whereby a backfit evaluation needs to be performed? - Region I no longer requires that this question be answered as part of the TIA. Since opening the URI (and drafting the TIA),

the licensee has performed a detailed engineering calculation and made operational changes such that the plant no longer requires support from the main generator to ensure reliability of the off-site power system.

As a result, any final agency position related to the adequacy of Ginnas prior approach would only allow us to provide the appropriate close-out of the URI and would not drive or result in any additional licensee actions at this point.

And for completeness; Question 3 from the TIA related to the degraded voltage relays has already been closed out.

Please let me know if you need anything else and once again, thanks to all for seeing this lengthy process to closure.

Region 1 took the action to discuss with their management the need for the TIA response considering licensee actions to address the issue. If the decision is made to keep the TIA request, R1 will follow up with me. Also please consider withdrawing the backfit question (question #2) assuming that the response to question 1 will be adequate to close the URI.

The response is available This version is a streamlined response which was recently concurred on by DE/EEEB and R1. Several questions were posed during OGC review of the TIA response and NRR would like clarity form the Region before deciding how to best move forward.
