Dear Commissioners and Staff:
On May 12, 2016, Pacific Gas and Electric Company (PG&E) requested approval (Reference 1) of a proposed amendment to Facility Operating License Nos. DPR-80 and DPR-82 for Diablo Canyon Power Plant (DCPP) Units 1 and 2, respectively. The license amendment request (LAR) proposed to revise Technical Specification 5.5.16 to replace the references to Regulatory Guide 1.163 (September 1995) and 10 CFR 50, Appendix J, "Option B-Performance-Based Requirements," with a reference to NEI 94-01, Revision 2-A, "Industry Guideline for Implementing Performance-Based Option of 10 CFR Part 50, Appendix J," dated October 2008.
The proposed change would have allowed an increase in the existing Type A test interval from 10 years to 15 years in accordance with NEI 94-01, Revision 2-A.
Subsequent to this submittal, the NRC issued requests for additional information (RAis). In one of the RAis, the NRC identified a change in regulatory position that would retroactively apply new guidance that was not applicable to DCPP at the time of the LAR submittal. PG&E has evaluated the additional resources needed to respond to the RAI, including adoption of the new guidance, and concluded that the benefit of the proposed change is no longer cost-justified. PG&E is hereby withdrawing LAR 16-03.
