Enclosed is a draft Commission Paper with a proposed Federal Register Notice in regard to a potential abnormal occurrence pertalnlng to t e seismic design errors at the Diablo Canyon Nuclear Power Plant with the subsequent suspension of the fuel load and low power operating license of Unit 1 on November 19, 1981.
The enclosed writeup is based on that provided by Region V.
AEOD recommends the item as an abnormal occurrence based on one of the general criteria of the Abnormal Occurrence Policy Statement; i.e.,
major deficienci es in design, construction, use of, or management controls for licensed facilities or material can be considered an abnormal occurrence.
It should also be noted that the Commissioners, in their approval of the Third quarter CY1981 AO Report, suggested the item as an abnormal occurrence for the Fourth quarter CY1981 AO Report.
