TO GOVERNOR BROllN'S PARTICIPATION IN SECURITY PLAN HEARING I.

INTRODUCTION AND DISCUSSION On June 11, 1980, Edmund G. Brown, Jr.,

Governor of the State of California (Governor), filed notice of his intent to "participate in the hearing on the security plan issue" to be held by the Atomic Safety and Licensing Appeal Board in the above-captioned proceeding.

As grounds for such parti-

cipation, the Governor of California stated that "the adequacy of Applicant's security plan is of central concern to the State of California and necessarily involves the responsibilities of the Governor and the Executive Branch of the State Government."

He also asserted that "certain information Iconcerning security measures]

is peculiarly available to the Governor."+

jl'he Governor was belatedly admitted to this proceeding as the representa-tive of an interested state under the provisions of 10 CFR 52.715(c) by the Atomic Safety and Licensing Board.

Given the present posture of this case - de novo review of the security matters by the Appeal Boar& - and the arguments set forth by the Governor in support of his petition, the NRC Staff interposes no objection to partici-pation by the Governor of the State of California in the upcoming security hearings P II.

CONCLUSION For the foregoing reasons, the NRC Staff does not object to participation by Governor Edmund G. Brown, Jr. of the State of California in the security hearings before this Appeal Board.
