SUMMARY

OF MARCH 6, 2017, CLOSED MEETING WITH EXELON GENERATION COMPANY, LLC, ON A FUTURE EXEMPTION REQUEST TO PLACE LEAD TEST ASSEMBLIES IN THE BRAIDWOOD REACTOR (CAC NOS. MF9276 AND MF9277)

On March 6, 2017, a closed meeting was held between the U.S. Nuclear Regulatory Commission (NRC) and representatives of Exelon Generation Company, LLC (the licensee) at NRC Headquarters, One White Flint North, 11555 Rockville Pike, Rockville, Maryland. The purpose of the meeting was to discuss a future exemption request associated with lead test assemblies with E110opt cladding alloy. The meeting notice and agenda, dated February 21, 2017, are available in the Agencywide Documents Access and Management System (ADAMS) at Accession No. ML17046A596. A list of attendees is provided as Enclosure 1.

The licensee presented proprietary information regarding the lead test assemblies. A non-proprietary version of the presentation is in the ADAMS at Accession No. ML17061A271.

The NRC staff queried the licensee about proprietary aspects of the lead test assemblies and the quality assurance program to be used to manufacture them. The NRC staff stated that since Title 1O of the Code of Federal Regulations (1 O CFR) Section 50.46 does not apply to lead test assemblies, an exemption is not necessary. However, the NRC staff emphasized that the licensee needs to ensure that the technical specifications allow the lead test assemblies to be placed in the reactor and a robust review under 10 CFR Section 50.59 needs to be performed to identify any aspects of the use of the lead test assemblies in the reactor that needs prior NRC staff review. The NRC staff encouraged the licensee to engage the NRC Region Ill Office regarding the 10 CFR Section 50.59 review early in the process to avoid last minute issues.
