Dear Mr. Baum,
We received the U.S. Nuclear Regulatory Commissions (NRC) letter stating that the subject project would have no effect on species listed or proposed to be listed under the Endangered Species Act (ESA) and requesting our concurrence with that determination. The letter is dated September 26, 2016, and arrived in our office on October 27, 2016. The ESA does not provide the U.S. Fish and Wildlife Service with a regulatory mechanism for concurring with no effect determinations, and Federal agencies that arrive at no effect determinations can proceed without contacting us.
Nevertheless, we wanted to acknowledge receipt of the letter. We sincerely appreciate NRC considering the effects of the project on listed species and keeping us informed. If you have any questions or concerns about this email, please contact me at your convenience. Regards,
