Status of 2.206 Petition Regarding Apparent 50.9 Violation at Diablo Canyon Power Plant (MF8123 and MF8124)

Good afternoon Mr. Lochbaum, This email is to provide you with an update on your 2.206 petition, which was submitted to the U.S. Nuclear Regulatory Commission (NRC) on July 14, 2016, as supplemented by email dated August 2, 2016. In your petition, you raised several concerns regarding 10 CFR 50.9, Completeness and accuracy of information, and the Diablo Canyon Power Plant (DCPP) license amendment request dated June 17, 2015. You requested that enforcement action be taken by the NRC, specifically for the NRC to issue a Demand for Information pursuant to 10 CFR 2.204 to Pacific Gas and Electric (the licensee for DCPP). Your request was reviewed by the NRCs Petition Review Board (PRB) and on November 9, 2016, the NRC provided you with a letter stating that the NRC accepted your petition for review.

The PRB is currently reviewing your petition and is working on a proposed Directors Decision. The NRCs target date to complete its review of the petition is March 2017.
