NOTICE OF Pacific Gas and Electric Company Diablo Canyon Nuclear Power Plant DEVIATION Docket:

50-275 License:

DPR-80 EA 96-180 During an NRC inspection conducted May 13 through May 28,

1996, a deviation from a commitment made in a November 1,

1995, letter (PGLE Letter DCL 241) was identified.

In accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions",

NUREG-1600, the deviation is listed below:

PGRE Letter DCL-95-241 dated November 1,

1995, stated that "The following additional MSSV testing will be completed during 1R7 and 2R7 outages at the Westinghouse test facility:

1) Valve signature profiles will be determined on live steam and with the AVK test equipment.
2) The magnitude of the AYK test equipment bias will be determined."

Contrary to the above, on November 24,

1995, the 1R7 outage was completed, but the licensee had determined the magnitude of AVK test equipment bias on only 9 of 20 Unit 1 MSSVs.

As of July 1,

1996, the licensee had not submitted a request for relief from its commitment to determine AVK test equipment bias during 1R7.

Please provide to the U.S. Nuclear Regulatory Commission, ATTN:

Document Control Desk, Washington, D.C. 20555, with a copy to the Regional Administrator, Region IV, a copy to the NRC Senior Resident Inspector at Diablo Canyon in writing within 30 days of the date of this Notice, (1) the reason for the deviation, or iF contested, the basis for disputing the deviation, (2) the corrective steps that have been taken and the results

achieved, (3) the corrective steps that will be taken to avoid further deviations, and (4) the date when your corrective action will be completed.

Where good cause is shown, consideration will be given to extending the response time.
