SUMMARY

- REGION IV OPERATOR LICENSING This refers to the meeting conducted in the Region IV office on November 10, 1994.

The meeting was related to discussion of training and operator licensing issues with Region IV licensee training representatives with special emphasis on consolidation, training rule, and changes to examiner standards.

The meeting was attended by those listed in Attachment 1.

The meeting agenda is presented in Attachment 2 with copies of the presentation handouts provided in Attachment 3.

The meeting was considered beneficial and provided an open forum for discussion by the NRC staff, licensees, and others in attendance.

gg(6 One of the topics discussed at the meeting concerned possible utility development of licensing examinations.

At that time, none of the NRC staff in attendance had seen the NRC's response to a proposal from Virginia Electric and Power Company to implement this process, even though it had been issued the week before.

For your information, enclosed as Attachment 4 is a copy of NRC's position on this issue.

When performed in a single week, IP 71001 would require 3

inspectors.

When a procedure module is coperformed, the added inspector would make the activity a major site activity.

Since IP 71001 specifically endorses in-office direct inspection, by requesting the material early and performing in-office DIE, the site IP 71001 contingent drops to two inspectors and the total site team to three, avoiding unnecessary HSA use.

550.120 Training and qualification of nuclear power plant personnel.

(a) Applicability. The requirements of this section apply to each applicant for (applicant) and each holder of an operating license (licensee) for a nuclear power plant of the type specified in 5 50.21(b) or 5 50.22.

(b) Requirements.

(1) Each nuclear power plant applicant, by November 22, 1993 or 18 months prior to fuel load, whichever is later, and each nuclear power plant licensee, by November 22, 1993 shall establish, implement, and maintain a training program derived from a systems approach to training as defined in 10 CFR 55.4.

The training program must provide for the training and qualification of the following categories of nuclear power plant personnel:

(i)

Non-licensed operator.

(ii)

Shift supervisor.

(iii)

Shift technical advisor.

(iv)

Instrument and control technician.

(v)

Electrical maintenance personnel.

(vi)

Mechanical maintenance personnel.

(vii)

Radiological protection technician.

(viii) Chemistry technician.

(ix)

Engineering support personnel.

(2) The training program must incorporate the instructional requirements necessary to provide qualified personnel to operate and maintain the facility in a safe manner in all modes of operation.

The training program must be developed so as to be in compliance with the facility license, including all technical specifications and applicable regulations.

The training program must be periodically evaluated and revised as appropriate to reflect industry experience as well as changes to the facility, procedures, regulations, and quality assurance requirements.

The training program must be periodically reviewed by licensee management for effectiveness.

Sufficient records must be maintained by the licensee to maintain program integrity and kept available for NRC inspection to verify the adequacy of the program.

Dear Mr. O'Hanlon:

We have completed our review of your proposal dated August 30,

1994, in which you recommended that the operator licensing examination process be changed to allow the facility licensee to be responsible for developing the written examinations and operating tests.

We have concluded that your proposal should be denied.

The NRC is bound by the Atomic Energy Act to prescribe uniform conditions for licensing individuals as operators and to determine the qualifications of such individuals.

The NRC's regulations and examination procedures that are currently in place satisfy both statutory requirements.

The changes you have proposed would likely lead to a significant increase in the national variation of the level of knowledge tested and examination difficulty, despite the NRC staff's efforts to control those. factors during the examination review and approval process.

Additionally, the NRC staff considers independence and objectivity to be critical factors in the initial operator licensing process.

Examinations drafted by a facility licensee could be unconsciously biased toward the specific material taught by the facility, or could lack the elements required to confidently measure operator knowledge and performance.'our proposal states that the same justification used to support the recent revision to the manner in which the NRC monitors facility requalification programs can likewise be used to justify your proposed changes to the initial licensing process.

The NRC staff considers the initial licensing of individual operators and the requalification of operators who have already demonstrated the knowledge and ability to receive a license to be significantly different as regulatory functions, and, therefore, disagrees that the justification to revise one provides sufficient support to revise the other.

Hr. James P. O'Hanlon Please note that the existing examination procedures encourage facility licensees to include their test item banks with the reference material that they submit to the NRC for use in examination development.

The procedures do not prohibit facility licensees from submitting proposed examinations, but they do place an upper limit on the percentage of test items that NRC examiners can take directly from the facility's item banks.

This completes our effort on this issue and we are, therefore, closing out TAC Nos.
