IN RESPONSE REFER TO M820304A UNITED STATES NUCLEAR REGULATORY COMMISSION WASHINGTON, D.C. 20555 ACTION - Denton The Commission was briefed on staff's conclusions and recommendations resulting from their review of the adequacy of the proposed seismic verification program and the qualifications and independence of the proposed contractors.

(Staff recommendations are contained in SECY-82-89).

The Commission:

by a vote of 4-1, with Commissioner Ahearne in the minority, disapproved a motion by Commissioner Ahearne (1) to reject the proposal of PGGE to retain Cloud Associates as th'e independent auditor to perform the proposed seismic design verification program; and (2) to accept, a proposal from PGGE, if submitted, to retain Teledyne Engineering Services in that, capacity; by a vote of.4-0, with Commissioner Roberts abstaining approved Commissioner Bradford's motion directing the staff (1) to make a concerted effort for one week to obtain an agreement among the parties (PGGE, State of California,, Joint Intervenors) for a proposed independent auditor or a list of auditors from which NRC would make a selection; (2) if this is not accomplished within the time period prescribed, the staff should proceed as otherwise directed;

unanimously approved the following additions to the recommendations contained in SECY-82-89:

"The contractor's role should include the following items, to be defined in the 'program plan and implementing procedures:

Scope and technical approach should be enlarged to include analysis of NSS vendors design; consideration of statistics in the sampling plan; and, inclusion of a sample of structural elements (see staff Conclusions chart presented at the Commission meeting).

by a vote of 4-1, with Commissioner Roberts dissenting approved the recommendations of the staff as, contained in SECY-82-89 as amended by b and c

above (one week effort to obtain agreement among the parties on an auditor or a list of auditors; modifications to the program plan).

The Commission instructed the staff that:

if the efforts to agree on a jointly approved contractor were successful, the staff could proceed with that selection; if the parties agreed on a short list, the staff could pick a company (such as Teledyne);

if efforts above were unsuccessful, the staff should proceed with the recommendations contained in SECY-82-89 as revised and voted upon by the Commission.

Two long days of discussions were held on Mednesday and Thursday.of last week among lawyers and technical persons representing PGKE, Governor

Brown, Joint Intervenors and NRC Staff concerning a possible settlement among all parties on the scope of Diablo Canyon Seismic Design Reverification program and the independent company or companies to carry out such a program, As a result of the apparent progress'chieved by these discussions, all parties agreed to extend the deadline for agreement until the following Tuesday.

The representatives then consulted with each of their respective parties over the next several days.

- On Tuesday of this week the parties reported to the NRC Staff the results of these consultations.

Based on these reports, the Staff concluded and all parties agreed that further discussions were not likely to be fruitful in reaching a settlement that all parties would accept.

NRC Staff, in accordance with the Commission decision of March 4, is now considering PGLE's proposal that Teledyne Engineering Services be approved.
