April 9, 1981 MEMORANDUM AND ORDER The Motion of March 17, 1981 by Governor Edmund G. Brown, Jr., to compel the Pacific Gas and Electric Company (PG&E) to answer interrogatories under oath is ~ranted.
In response to Governor Brown's interrogatories dated February 20,
- 1981, PG&E responded on March ll, 1981, by filing a list of unsworn answers to said interrogatories.
Subsequently, in statements dated April 1, 1981, one James D. Shiffer and one James B.
Hoch-stated that they had prepared answers to Governor Brown's interrogatories 1 through 7.
In addition, on each statement, it was written "I declare under penalty of perjury that said answers are t'rue and correct."
The Board finds that such statements do not meet the requirements of 10 CFR 2.740b(b) in that the answers were not under oath or affirmation.
The
Board further finds that the deficiencies noted were not cured by Mr'.*
Shiffer's and Mr. Hoch's statements dated April 1, 1981.
On this 9th day-'f April 1981, it i s ORDERED That the answers to interrogatories 1 through 7 be reiterated by the person who prepared
- them, and that said person sign them under oath stating that they are true and correct, and that the respondents are authorized to answer for PGSE in this matter.
