UNION OF CONCERNED SCIENTISTS REQUEST TO PARTICIPATE AS AMICUS CURIAE On June 16,

1980, the NRC issued a "Statement of Policy for Further Commission Guidance for Power Reactor Operating
Licenses, 45 Fed.

As this Commission is aware, the Union of Concerned Scientists and five other groups filed a Petition for Review of that Policy Statement, in the United States Court of Appeals.

Subsequently, the NRC withdrew the Policy Statement and replaced it with "Further Commission Guidance for Power Reactor Operating Licenses:

Revised Statement of Policy,"

The NRC and the Petitioners then agreed to a voluntary withdrawal of the Petition for Review on the grounds'f mootness, believing that the Revi.sed Policy Statement had corrected the deficiencies complained of.

On February 17, 1981, the Licensing Board for the above-captioned issued a Prehearing Conference Order which, inter alia, rejected contentions of intervenors based upon an interpretation of the Revised Policy Statement which UCS believes is unconsistent with the language and intent of

that. document, contrary to law and which, if adopted, would require UCS to move the Court to vacate the withdrawal of its Petition for Review.

Therefore, UCS requests permission to address the Commission as amicus curiae in support of the requests for certification filed by the 'Joint Xntervenors and Governor Brown in order to urge the Commission to correct the error of the Licensing Board.
