Dear Hs. tietcalf:

Your letter of August 2Q, 1979 to Chairman Hendrie has been referred to me or reply.

Given below is the status of each of the four cases you mentioned.

A decision on licensing the operation of ihe Diablo'anyon Nuclear Power Plant has not yet been made by the HRC Atomic Safety and Licensing Board.

Hearings on the seismic aspects vere completed on February 15, 1979.

There is a motion pending before the Board to reopen the record on emergency planning and the effects of the Three t~iile Island accident..

Three l'file Island Unit 4o.

1 will remain shut down until the Nuclear Regulatory Commission has determined, after a public hearing, that it can be operated without endangering the public health and safety.

Three Aile Island Unit ho.

2 is not operable and won'.t be for a long tim to come.

Licensing revilers by HRC staff on the huclear Plant Separations Facility of Allied General Nuclear Services at Barn.; 11, South Carolina, were ended as a

result of a decision by the iT'uclear Regulatory Commission in December 1977 to terminate actions on plutonium recycle-related license applications except for those portions of proce dings vhich involve spent fuel storage, disposal of existing v:aste, and decontamination or deco:~nissioning of existing plants.

At the same time, the Commission reserved for decision, if it arises, the question of;;he her a facility such as the Barm ell facility may.be licensed for experim ntal an~ feasibility purposes on a noncommercial basis to in-vestigate processes which support the nation's nonproliferation objectives.

There is a licensed commercial lov-level waste burial ground at Barnwell, but a limit has been placed by the State of South Carolina on the volum which

'may be 'accepted.

Radioactive wastes from defense programs of the Department of Energy are stored at Savannah River, South Carolina, but are not subject to itRC licensing.'rncc+
