FOIA/PA-2016-0142A FOIA/PA-2016-0613 On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your letter dated August 11, 2016, in which you appealed the agency's July 26, 2016 response related to your July 8, 2016 Freedom of Information Act (FOIA) request, FOIA/PA-2016-0631. You appealed the adequacy of the search conducted by the NRC for a June 13, 2014 NRC Press Release related to Nogales Sabotage.
Acting on your appeal, the NRC Office of Public Affairs (OPA) conducted a thorough search for these records and no records were located. Therefore, I conclude that the search performed was adequate and your appeal is denied.
This is the final agency decision. As set forth in the FOIA (5 U.S.C. 552(a)(4)(B)), you may seek judicial review of this decision in the district court of the United States in the district in which you reside or have your principal place of business. You may also seek judicial review in the district in which the agency's records are situated or in the District of Columbia.
