I am contacting you to provide a status update on the petition for rulemaking (PRM) docketed as PRM-26-5 submitted by the Nuclear Energy Institute (NEI). The PRM requested that the NRC amend certain regulations that govern fitness for duty programs for nuclear power plant workers. These regulations are found in Part 26 of Title 10 of the Code of Federal Regulations. The NRC published a notice of receipt of PRM-26-5 in the Federal Register (FR) on October 22, 2010, at 75 FR 65249. On May 16, 2011, the NRC published a notice in the Federal Register at 76 FR 28192 to inform the public that the NRC has decided to consider the issues raised in PRM-26-5 in the Quality Control/Quality Verification rulemaking. In the Federal Register notice published on December 9, 2015 (80 FR 76394), the NRC announced that it is discontinuing the QC/QV rulemaking and will issue a subsequent action on the determination of PRM-26-5. The subsequent action was discussed at the public meeting held at NRC Headquarters on February 25, 2016. The NRC explained that PRM-26-5 will now be handled under the PRM process for resolution. The public meeting summary is available on the Federal rulemaking Web site at http://www.regulations.gov by searching on Docket ID NRC-2010-0304. The NRC continues to address the resolution of the issues raised by PRM-26-5.
