FOIA/PA-2016-00119A FOIA/PA-2016-00446 On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your letter dated June 18, 2016, received on July 14, 2016, in which you appealed the agency's June 9, 2016, decision related to your April 11, 2016,, Freedom of Information Act (FOIA) request, FOIA/PA-2016-00446. You appealed the adequacy of the search conducted by the NRC.
Acting on your appeal, I have considered the matter and have determined that the NRC did not locate any agency records responsive to your request for NRC Contract #JCN W4116. No additional records were located in response to FOIA/PA-2016-0446. JCN W4416 is a job code.
Numerous contracts were awarded using that code for multiple years. You were advised in closeout of FOIA 2016-0446 to provide a contract number to enable a proper search for the contract. Therefore, I have denied your appeal.
This is the final agency decision. As set forth in the FOIA (5 U.S.C. 552(a)(4)(B)), you may seek judicial review of this decision in the district court of the United States in the district in which you reside or have your principal place of business. You may also seek judicial review in the district in which the agency's records are situated or in the District of Columbia.
The 2007 FOIA amendments created the Office of Government Information Services (OGIS) to offer mediation services to resolve disputes between FOIA requesters and Federal agencies as a nonexclusive alternative to litigation. Using OGIS services does not affect your right to pursue litigation.
